Case Summary:

On January 30, 2013 another one of Chen Immigration Law Associates’ EB1A (EB1-EA) cases was approved for a petitioner in the field of biochemistry. In EB1A cases it is imperative to not only prove that the field of study has merit, but that the petitioner has risen to the top of their field of endeavor. Additionally, it is vital that the client who is petitioning for approval as an Alien of Extraordinary Ability is able to demonstrate that their achievements are recognized by other experts in the field as beneficial to the United States

In this particular case, we discussed this client’s work in the field of biochemistry, and specifically his contributions in biochemistry for the prevention and treatment of a variety of gastrointestinal diseases and cancer. In order to argue that this work was “extraordinary,” we at Chen Immigration Law Associates drafted eight recommendation letters that were reviewed, edited, and signed by the recommenders. Of these eight letters, six were from independent recommenders; experts who did not know or work with this client. In this specific case, the client had published a significant amount of works, but was not the first author in the majority of his most cited publications. Furthermore, in order to set this client apart, we presented evidence of his positions as peer reviewer and leadership roles in professional organizations. Moreover, we used analytical software that demonstrated that the work of this client in bacterial lip modifications and properties of villin were at the top 1% of researchers throughout the United States.

Therefore, we were able to demonstrate that this client met the criteria for an EB1A petition and we received approval for this client in 80 days without premium processing.
