On October 10th, 2016, we received another EB-1A (Alien of Extraordinary Ability) approval for a Lecturer in the Field of Computer Science (Approval Notice).

General Field: Computer Science

Position at the Time of Case Filing: Lecturer

Country of Origin: China

State of Residence at the Time of Filing: Tennessee

Approval Notice Date: October 10th, 2016

Processing Time: 12 months, 4 days

Case Summary:

A little over a year after North America Immigration Law Group (WeGreened.com) filed an EB-1A (Alien of Extraordinary Ability) petition on behalf of a lecturer from China, the USCIS approved his petition. We also filed an EB-2 NIW (National Interest Waiver) petition on his behalf and it was approved less than four months later. Although it was a bumpy road to the EB-1A finish line (the USCIS issued a Request for Evidence), we are pleased that our client is now significantly closer to green card success. He can now file an I-485 application and adjust his status for permanent residence without waiting several years for his priority date to become current. Similar to the information we included in his NIW petition dossier, we detailed the following in our client’s EB-1A petition:

  1. Citation Count & Publication Record: We used Google Scholar and other sites such as Scopus to determine our client’s citation count. At the time of filing, his 12 published papers had collected 61 citations.
  2. Peer Review Experience: As only the cream of the crop are invited to assess the work of their peers, the 52 times that our client had conducted peer reviews proved his high standing in the field of computer science.
  3. Testimonials: The six recommendation letters that we included in our client’s NIW petition was also incorporated into his EB-1A dossier. These recommendation letters contained statements such as this: “As we continue to advance our robotics technology, the applications in healthcare continue to improve and expand, resulting in better patient care and more lives saves. [Client’s] research is instrumental in reaching these goals.”
  4. Research Information: To prove to the USCIS that our client is one of only a handful of researchers who can obtain such useful research results, we carefully accounted for his work on the development of intelligent robots and proved that his findings are applied in wearable robotics that allow for improved everyday experience for the visually impaired.

We congratulate our client for obtaining an EB-1A petition approval and thank him for trusting our law firm to help him with the first step of the green card process.
