Case Summary:

A prominent postdoctoral research associate from China hired North America Immigration Law Group to help him with the first step of the green card process: filing an I-140 petition. After evaluating his credentials, we determined that he qualified to file his petition under the EB-1A (Alien of Extraordinary Ability) visa category. Considering that EB-1A has a very high standard of law, our legal team worked diligently to prove to the USCIS that our client’s petition deserved to be approved. Here are some of the things our petition focused on:

  1. Professional Achievements: The best way to showcase our client’s achievements was to detail his citation and publication count. Using Google Scholar and other references, we determined that his work had gathered 136 citations and that he had published 8 articles at the time of filing. We also listed the 45 times he assessed the work of other microbiologists for 13 high impact scientific journals.
  2. Continuous Research Endeavors: We had to prove to the USCIS that our client is an active leader in his field of microbiology. We accounted for his various projects on developing novel drugs and vaccines for combatting and preventing infectious diseases and its rapid proliferation. Using the information amassed, we established that our client’s work is of inherent value to the United States, particularly to its medical sector.
  3. Strong Support from Peers: Recommendation letters provided by other expert microbiologists played an important role in our EB-1A petition packet. They firmly supported our argument that our client’s research progresses the work of other scientists, and that their collective work greatly benefits the United States as a whole. One of these experts had this to say about our client: “[Client] has already established himself as a leader in the field, a position acknowledged by his peers who utilize his findings in support of their own research. Further validating his contributions is the commercialization of his work, an indisputable indication of the applicability and implementation of [Client’s] studies. Three months after we initially submitted the EB-1A petition on our client’s behalf, he decided to upgrade his case to Premium Processing to speed up adjudication. Nine days after the upgrade, he received an approval notice from Nebraska Service Center.
