On July 13th, 2022 and July 19th, 2022, we received another EB-1A (Alien of Extraordinary Ability) and EB-2 NIW (National Interest Waiver) approval for a Senior Process Engineer in the Field of Pharmaceutical Science (Approval Notice).
General Field: Pharmaceutical Science
Position at the Time of Case Filing: Senior Process Engineer
Country of Origin: India
State of Residence at the Time of Filing: Illinois
The EB1-A or Alien of Extraordinary Ability visa is an employment-based, first-preference visa for a noncitizen of extraordinary ability. As the name suggests, the top requirement for this visa type is evidence of extraordinary ability in the sciences, arts, education, business, or athletics through sustained national or international acclaim. At the same time, the NIW or National Interest Waiver visa is granted to those noncitizens whose work proves to be of some national interest to the United States. The NIW visa grants exemption from a permanent job offer from a U.S. employer and waives the labor certification requirement too.
This is why when our firm received a request for filing an NIW and later an EB1-A application from an Indian senior process engineer in the field of pharmaceutical science, we made sure to first know his academic and professional qualifications to determine whether his case would qualify for the two categories. Once we were certain that his case had merit, we made sure to put together every relevant information for his petitions. This included the following:
- Updated CVs
- Transcripts from colleges and universities
- Certificates from academic and professional institutions
- Record of publication and citations
- Record of peer review service
- Record and details of his research project and major funding sources
- Letters of recommendation from experts in his field of study
We were thus soon able to compile an impressive list of achievements for our client which could both prove his extraordinary ability as well as his importance to the United States of America. One of the ways this was made possible was through testimonials from experts. An excerpt from one is presented below:
“[The client] is an expert scientist in the field of pharmaceutical science whose insightful research on drug delivery and formulation development has provided new knowledge regarding treatment for a myriad of illnesses. His research is inherently valuable for the interests of the United States, and I believe that his presence in the United States is necessary for such progress to continue at its present pace.”
On the other hand, we said that as an expert in the field of pharmaceutical science, his proposed endeavor is to continue his development of novel dosage forms in an ideal range for pharmaceutical applications. Among other applications, his research is relevant to the treatment of skin diseases, ulcers, and heart disease, and the success of the U.S. pharmaceutical industry. In addition, beyond its medical benefits, his endeavor is of great economic importance thus making a significant contribution to the country’s prosperity.
He has also completed at least 53 reviews to date. His research has resulted in 35 peer-reviewed journal articles (4 of them first-authored) and two books and these publications have been cited a total of 225 times according to Google Scholar. We also produced evidence of his funding from the All India Council for Technical Education.
