Case Summary:

With years of experience working in the field of molecular biology under his belt, our client had amassed an impressive array of accomplishments that made him a suitable candidate for EB-1A (Alien of Extraordinary Ability). Our client, a clinical data analyst from Taiwan, hired North America Immigration Law Group (WeGreened.com) to help him obtain green card success. There are two steps in this process: filing an I-140 petition (which we did under EB-1A) and filing an I-485 application.

Filing an EB-1A Petition:

Filing an I-140 petition is a significant hurdle in the green card process. In this case, we filed our client’s petition under the EB-1A visa category and had to prove that not only is he an asset to the molecular biology community, but also to the United States. We compiled a wealth of information on his various achievements to build a strong EB-1A case on his behalf. When we were ready to file the case, our client’s petition was partly composed of the following:

  1. Recommendation Letters: In order to prove to the USCIS that our client’s work is essential to other researchers as well as to the nation, we needed other experts in the field to corroborate our claim. Our client reached out to a handful of experts, four of whom agreed to lend their support. They advocated for the approval of our client’s EB1A petition by signing recommendation letters that contained statements such as this: “The creative and talented mind that [Client] possesses is not only valuable to the field of molecular biology, but also to the United States in general, especially given the implications his work has for the development of novel treatments for life-threatening diseases that plague the United States. I advise that we encourage and support his continued work in order to promote and maintain progress in the medical field, as well as our competitive edge in this area.”
  2. Publication, Citation & Peer Review Record: When we filed the case, our client’s publication record stood at 22 scientific papers, his citation count was a staggering 1647, and he had conducted 4 peer reviews for scientific journals.
  3. Research Information: We determined that our client’s work is focused on the characterization of micro-ribonucleic acids (miRNAs), and that his findings benefit the U.S. medical sector by progressing the understanding of fundamental cellular activities and the development of disease related to miRNAs.

Filing an I-485 Application:

Not long after our client received news of his EB-1A petition approval, he retained our services to help him file I-485 applications for himself and his spouse. We recently submitted the documents on their behalf. We look forward to helping them attain permanent residency and we thank them for choosing to work with our law firm.
