On November 22nd, 2021 and February 7th, 2022, we received another EB-1A (Alien of Extraordinary Ability) and EB-2 NIW (National Interest Waiver) approval for a Postdoctoral Scholar in the Field of Materials Science (Approval Notice).

General Field: Materials Science

Position at the Time of Case Filing: Postdoctoral Scholar

Country of Origin: China

State of Residence at the Time of Filing: Pennsylvania

Approval Notice Date: November 22nd, 2021 (EB-1A) and February 7th, 2022 (NIW)

Processing Time: 13 days (EB-1A) (Premium Processing Requested) and 13 months, 17 days (NIW)

Case Summary:

The USCIS has always been very clear about the requirements for the EB1-A (Alien of Extraordinary Ability) and NIW (National Interest Waiver) categories of visas. They require a few things in particular.

  • Proof of the extraordinary ability of the applicant.
  • An indication that this ability is aligned with the interests of the United States.
  • Assurance that he will continue to work in their proposed field of endeavor.

This is where our NAILG comes in. We help our clients to put their best foot forward with our case preparation strategy. So when an expert in the field of materials science from China wanted to file his EB1-A and subsequently his NIW petition, we made sure that his abilities were showcased as best as possible. This we were able to achieve by including the following information in their application packet:

  • Details of his proposed endeavor which was to continue his research on developing new material characterization approaches to identify ideal materials for use in electric applications to improve computer calculation speeds and energy efficiency.
  • Indication of the use of his research for the U.S., which is why we showed that his research on antiferromagnetic spintronics and novel materials for use in electric applications assists in the competitiveness of the American electronics product sector, it is in direct alignment with the economic interests of the United States.
  • Details of his publication history, showing evidence of 17 peer-reviewed journal articles (6 of them first-authored or co-first-authored).
  • Evidence of citation record of these publications which stands at a total of 501 times according to Google Scholar.
  • Evidence showing his review experience for other journals in his field 6 times in the past.
  • Evidence of support shown by other experts in his field through 5 letters of recommendation received from dependent and independent sources. Two of these said:

“… the research conducted by [the client] into novel ferromagnetic two-dimensional materials, with applications in nanoelectronic and spintronic devices, is directly related to American energy interests. Furthermore, as I shall convey throughout the rest of this letter, [the client] is among the most talented and influential recent scholars in the materials science field. I therefore wholly endorse his continued scholarship in the United States as vital to the energy interests of this country.”

“Electronic nanodevices have a number of applications in energy transport, storage, and conversion that directly bear on the energy interests of the United States…the research conducted by [the client] into novel ferromagnetic two-dimensional materials, with applications in nanoelectronic and spintronic devices, is directly related to American energy interests.”

Thus, having shown that our client was indeed a valuable asset to the United States, we were able to get him both EB1-A and later his NIW cases approved.
