Success Story: EB-2 NIW (National Interest Waiver) Approval for a Postdoc Researcher in Medicine

Client’s Testimonial:

I am happy to recommend your firm.

On February 12th, 2013, we received another EB-2 NIW (National Interest Waiver) Approval for a Postdoc Researcher in the field of Bio-Medicine. Approval Notice)

General Field: Medicine
Position at the Time of Case Filing: Postdoc researcher
National Origin: Vietnam
Service Center: Nebraska
Processing Time: 8 months
State Residing at the Time of Filing: OH

Case Summary:

The Nebraska Service Center has been known for a more strict adjudication standard and low approval rate. However, our approval rate with NSC for our NIW cases is still 100 %, indicating the successful nature of our strategies when preparing for NIW cases.

As a firm that prides itself in its work, we at Chen Immigration make it our goal to achieve as close to 100% approval rating for our clients’ cases. Sometimes it is very difficult to procure EB-2 NIW case approvals for clients whose academic citation number is relatively low. This client only has 16 independent citations at the time we filed his case. When cases like these arise we use our best means to assure a swift case approval. Although this case was pending for 8 months with NSC, longer than most of our cases, the case was approved without RFE (Request for Evidence).

In this case we at Chen Immigration used other factors such as obtaining recommendation letters from exceptional people who work in the same field as our client, as well as comparing our case to similar cases that were approved via the AAO to help compensate for the client’s relatively low citation count. When we assist clients of this type, we work diligently to obtain the highest quality of recommendation letters. These are a crucial portion of the petition and can be a very strong asset to the client’s approval. In this case, we highlighted the status and quality of recommendations and recommenders in our petition which resulted in our client’s decisive approval.

In addition, in order to provide evidence that this client was “seeking employment in area of substantial intrinsic merit,” we at Chen Immigration Law Associates emphasized that the clients’ work was national in scope, and that the national interest would be adversely affected if a labor certification were required. Through the use of our second-to-none case methodology and client-partner relationship, we made an indisputable case for approval for this case. Specifically, we illustrated the client’s exceptional experience in the field of medicine through the letters of many distinguished industry experts across the medical and bio-medical research community.

Using this proven strategy, while correctly articulating the importance surrounding this client’s valued work, we at Chen Immigration Law Associates were able to secure approval for this petition on February 12th 2013.

With this in consideration, it is important to emphasize that the processes and expertise practiced by Chen Immigration Law Associates. Not only do we develop the best possible strategies for each case, but we execute these strategies with the utmost effectiveness!
