Success Story: NIW Approval for a Postdoctoral Research Associate in Electrical Engineering

Client’s Testimonial:

[Chen Immigration Law Associates]: I received a notice from USCIS today which apparently is the approval notice!! I wanted to thank you for your help and efforts. It came much earlier than my expectation, I thought is would come around mid May.

Recently, we at Chen Immigration Law Associates received another EB2 NIW (National Interest Waiver) Approval for a Postdoc researcher specializing in Electrical Engineering. Approval Notice)

General Field: Electrical Engineering
Position at the Time of Case Filing: Postdoctoral Research Associate
National Origin: Iran
Service Center: Texas
Processing Time: 48 days
State Residing at the Time of Filing: Pennsylvania

Case Summary:

We at Chen Immigration Law strive for excellence in our work. We not only maintain approval rates for our guaranteed cases as close as 100%, but we also continue to surpass the norm for case processing time. This case was no exception, and was approved in 48 days, which is less than half of the typical EB-2 NIW processing time.

We at Chen Immigration make sure to work directly with our clients every step of the way to both ensure case approvals and also assure client satisfaction. In this case, we procured evidence that would aid the client in achieving a swift approval. We did this in three steps. First, we worked towards proving that this client was seeking employment in an area of substantial intrinsic merit. This client had achieved several advanced degrees, specifically a PH.D In Electrical Engineering. In addition to this client’s academic accomplishments we highlighted our client’s international clout whereby they were a peer-reviewer for at least 3 internationally esteemed scientific journals. In particular this client was invited to review papers for journals such as IEEE transactions on Biomedical Engineering. Also our client was invited to present their findings at large prestigious national and international conferences including the 13th International Conference on Electrical Engineering and 16th International Conference on Digital Signal Processing.

Secondly, we gathered evidence to support the proposed benefit of this client’s work and its overall national benefits. Using our effective case processing methodology we worked with the client and used our research technology to procure evidence and recommendation letters that would ensure a case approval. Specifically those who recommended our client stated: ‘The ramifications of Dr. X are clear, as his groundbreaking research has the potential to positively influence the lives of millions of children here in the United States,’ as well as ‘Dr. X’s novel methods in studying the human brain connectome using a combination of structural and functional imaging, have helped colleagues in his field obtain a far greater wealth of information regarding brain activity of autism patients, which has had the effect of opening new opportunities for research.’

Finally, we proved that the national interest would be adversely affected if a labor certification were required. As this is arguably the most daunting task associated with filing EB-2 NIW (National Interest Waiver) petitions, it is important that each case establishes evidence directly corresponding to their claimed criteria. We at Chen Immigration Law Associates believe in gathering evidence in such a manner that each criterion is so well supported that the adverse effects associated with an unfavorable ruling are insurmountable. Specifically we proved that this client’s research was essential to the US because it was the only of its kind with specialization in biomedical engineering and signal processing, bioinformatics, algorithm development, machine learning, and medical image analysis.

Using this proven strategy, while correctly articulating the importance surrounding this client’s valued work, we at Chen Immigration Law Associates were able to secure approval for this petition on March 19th, 2013.

With this in consideration, it is important to emphasize that the processes and expertise practiced by Chen Immigration Law Associates. Not only do we develop the best possible strategies for each case, but we execute these strategies with the utmost effectiveness!
