Case Summary:

North America Immigration Law Group was hired to file an I-140 NIW (National Interest Waiver) petition for a staff research scientist from India. Before preparing our client’s case, we evaluated her planned research work in the field of computational biology on developing novel computational methods to characterize the genetic makeup of cancers and identify genomic biomarkers of drug response and cancer relapse in order to improve cancer patient outcomes. Her research seemed to be of great importance because it advances knowledge related to the mechanism of cancer and helps in identifying biomarkers, further contributing towards positive patient outcomes.

Additionally, we noted that our client held a Ph.D. in computational biology and medicine and she is a highly qualified scientist aiming to treat various types of cancer, advancing the medical sector, and improving public health. We mentioned that her well-to-do research has already persuaded her peers and other well-known researchers in the field to a great extent. At the time of filing, she had already acquired 1610 citations from the 11 peer-reviewed journal articles (1 of them first-authored and 1 of them co-first-authored) she published in no fewer than 8 highly ranked peer-reviewed journals. Moreover, at least 10 of her writings are among the most highly cited in the field, showing both the originality and significance of her ways and results.

In recognition of the significance of her work, which has been granted funding by the National Institutes of Health (NIH). Sustained support from national federal institutions such as this clearly demonstrates a researcher’s ability to address pressing matters of national concern. Therefore, the receipt of such awards is demonstrable evidence of her research’s utility to national public health. Also, we observed that our client is a vigorous member of the scientific community for highly acclaimed journals and conducted 4 peer reviews that highlight her grand position in this area as a judge of the work of others.

Further, we supported our client’s-built petition by adding two recommendation letters that she obtained from leading experts in the field along with her advanced degree, CV, and employment letter altogether confirming her unique position to persevere her work considering her experience, as well as her leadership and expertise in the field. We concluded that there is an urgent national need for her continuing contributions, which are vital to treating millions of Americans suffering from debilitating conditions such as cancer. Thus, the research that she is pursuing has tremendous national merit as it directly improves the health and wellbeing of Americans.

We were very much able to persuade USCIS of our client’s research efforts that are contributing significantly to the United States in numerous ways and he must be furthering her offered endeavor. We are glad that she received the EB-2 NIW petition approval 8 months and 24 days after her case was filed. We congratulate her on this major breakthrough and thank her for trusting us throughout the process.
