General Field: Civil Engineering

Position at the Time of Case Filing: Civil Engineer

Country of Origin: Turkey

State of Residence at the Time of Filing: Outside the US

Approval Notice Date: January 12th, 2018

Processing Time: 10 months, 16 days

Case Summary:

A civil engineer based in Turkey hired North America Immigration Law Group (NAILG) to help him prepare and file a personalized EB-2 NIW (National Interest Waiver) petition. Based on the guidelines set by Matter of Dhanasar, our client was a good candidate for the national interest waiver.

Although our client was abroad while we worked on his case, we kept the channels of communication open and built a very strong case for him. The NIW petition dossier which we put together contained an array of information pertaining to his work in the field of civil engineering. For instance, we listed the 11 peer-reviewed journal articles (3 of them first-authored) and 17 peer-reviewed conference papers to his name as well as the 31 times his work was cited by other researchers. On top of that, we reviewed and summarized his research on structural health monitoring through nondestructive evaluation techniques.

After months of hard work, we put together a well-crafted NIW petition that emphasized the value of our client’s work to the US. In essence, we proved that his research directly contributes to the methods used to evaluate existing buildings and create new ones, and that work  positively impacts maintenance of the United States’ civil infrastructure, such as roads, bridges, and buildings.

To further fortify our client’s customized NIW petition, we included recommendation letters signed by a handful of other prominent civil engineers. According to one of them, our client “is not only an experienced practical engineer but also a forward-thinking scholar…” Another recommender noted that “supporting the continuation of [Client’s] research is certainly within the interests of the United States.”

We are pleased that our client was granted the national interest waiver, and we wish him the best as he completes the final step in the green card process from outside the US: undergoing immigrant visa processing. We thank him for choosing us to represent his NIW case, and we look forward to welcoming him as a US permanent resident.
