General Field: Environmental Microbiology

Approval Notice Date: October 20th, 2020

Processing Time: 19 months, 24 days

Case Summary:

North America Immigration Law Group was approached to document an EB-2 NIW (National Interest Waiver) petition for a postdoctoral scholar. With a Ph.D. in plant pathology and researching the field of environmental microbiology, our client displayed all the required skills to achieve the national interest waiver. As a part of our legal services, we evaluated his credentials and ensured the relevant documents to be produced to the USCIS. Once the assessment was done, we organized a strong petition packet for our client, consisting of:

  • Primarily, we described his research on understanding the evolution of bacterial plant pathogens and the use of natural products and organisms to control them. We also concluded that the research in his area is of great importance because it is essential to preventing the spread of some of the world’s most prevalent and dangerous pathogens affecting crop plants.
  • Besides, we recorded the 43 citations accumulated from the 5 peer-reviewed journal articles (four of them first-authored) he published. Likewise, our client is an active member of the scientific community as a peer-reviewer and assessed the work of others in the field 6 times, signifying his solid hold in this field.
  • Furthermore, to bolster his case, we added six recommendation letters that he obtained from other leading experts in the field, asserting that our client’s research aims to understand and halt the proliferation of pathogens affecting crop plants, which benefits agriculture in the United States. One of his recommenders stated:

“[Client] has provided important information on how the natural competence of the bacteria fosters its spread and destructive abilities. Such work increases the speed of progress in fighting this bacterium and reducing its economic impact. This makes it clear that he is a nationally important researcher who improves the agricultural stability of the United States.”

Despite a long wait, our client successfully achieved the EB-2 NIW approval, without an RFE (request for evidence). We are grateful for helping him, and we would like to thank him for trusting and cooperating with us throughout the process.
