On April 18th, 2017, we received another EB-2 NIW (National Interest Waiver) approval for a Research Staff Member in the Field of Computer Science (Approval Notice).

General Field: Computer Science

Position at the Time of Case Filing: Research Staff Member

Country of Origin: Italy

Service Center: Nebraska Service Center (NSC)

State of Residence at the Time of Filing: New York

Approval Notice Date: April 18th, 2017

Processing Time: 13 months, 3 days

Case Summary:

A research staff member from Italy hired North America Immigration Law Group (NAILG) to help him and his spouse obtain their green cards. There are two steps involved in the green card process (filing an I-140 petition and an I-485 application) and our client retained us to help him with both. Exactly 13 months and 3 days after his I-140 petition was filed, he received notification of case approval. Even better than that, he learned that their I-485 applications had been approved 2 months later. The reason why the USCIS took action on their I-485 applications so quickly is because he chose to file them while his I-140 was pending approval, which essentially gave the USCIS a head start in the adjudication process.

In this case, our client’s I-140 petition was filed under EB-2 NIW (National Interest Waiver), and these are some of the key points that paved the way for case approval:

  • The 300 citations collected from his work as a researcher in the field of computer science.
  • His 8 peer-reviewed journal articles, 27 peer-reviewed conference articles, 2 book chapters and a published Ph.D. thesis.
  • His doctoral degree that proved he is equipped with the theoretical and practical knowledge to continue progressing the field of computer science.
  • The five recommendation letters signed by other professionals in the field, all of whom advocated for the approval of our client’s NIW petition. According to one of them: “[Client] has an immense global influence on high-performance computing research, and he represents one of the most accomplished researchers in this discipline.”
  • Details of his research related to the development of software tools and optimizations to support high-performance computing applications.

Overall, we were able to prove to the USCIS that our client’s research contributes to the United States government’s and industries’ goal of reaching the Exascale level of high-performance computing processing. We congratulate him for securing a green card, and we wish him the best as he continues to conduct outstanding research here in the United States.
