Case Summary:

North America Immigration Law Group (NAILG) was hired by a data scientist/engineer to put together and submit an eloquent EB-2 NIW petition packet on her behalf. The USCIS responded to our presentation in a positive manner and granted their approval in just 5 months and 17 days.

With a Master of Science in biomedical engineering and extensive involvement in the field of biomedical data science, our client was a suitable candidate for the national interest waiver. We focused on her professional performance and built a strong case around her various achievements. At the time of filing, she had collected 14 citations. Additionally, her many years in the field had led to the publication of 5 peer-reviewed journal articles (one of them first-authored), 1 book chapter (first-authored), and 1 conference paper (in press). We also noted the 4 times our client assessed the work of her peers which demonstrated her position as a leading expert in her field. Using these numbers, we convinced the USCIS that our client’s research is of utmost importance to the research community.

Although we managed to establish the value of our client’s work, we needed other experts in the field to concur. We did this by urging our client to obtain recommendation letters from her peers, and to our delight, she returned with 5 signed letters. According to one of her recommenders: “Through her research in the biomedical data science discipline, [client] is working on original approaches to mitigate the damaging effects of strokes. By applying state-of-the-art analytical approaches, she is developing superior strategies and treatments to deal with this global problem. In particular, she is working to help those affected by strokes regain lost functionality in their hands. An important aspect of the case was our client’s research projects. We needed to prove to the USCIS that she is working in an area that is important to the U.S. and that her findings are benefiting the nation. Through her research summary, we demonstrated that her findings on identifying neural mechanisms responsible for recovery after brain injury and utilizing machine learning, mathematical models, and advanced algorithms to design personalized rehabilitative technologies are advancing rehabilitative procedures through the application of cutting-edge technology.

Because we were able to prove to the USCIS that our client’s investigation advances the United States, she is now one step closer to permanent residence.
