Case Summary:

A mere 38 days after North America Immigration Law Group (WeGreened.com) filed an EB-2 NIW (National Interest Waiver) petition on our client’s behalf, Texas Service Center sent us an approval notice. Although our client was born in China, she does not have to wait for her priority date to become current before taking the final step towards her green card: the I-485 application. Seeing that her husband was born in Taiwan, the rules of cross-chargeability apply to her, meaning her I-485 application will be charged according to Taiwan’s quota and not China’s. In a nutshell, petitioners born in China whose I-140s were recently approved under the EB-2 visa category have to wait roughly several years for their priority date to become current before applying for their green card, whereas those from Taiwan can apply immediately.
