Case Summary:

An expert associate research scientist from Germany engaged the legal services of North America Immigration Law Group to help him prove to the USCIS that he qualified for the national interest waiver. As we filed his I-140 petition under EB-2 NIW (National Interest Waiver), we had to prove that his work is of value to the United States and that not many other researchers working in the field of RNA biochemistry can take his place.

Assembling a Convincing Petition:

As the attorney-on-record, we were tasked with persuading the USCIS to approve our client’s EB-2 NIW petition. In order to do that, we had to present evidence that highlighted his ability to conduct outstanding research in the field, and that the results yielded are important to the United States. We listed his Ph.D. in Biochemistry (to prove that he has sufficient understanding of the field), the 448 citations to his work (to demonstrate that other researchers rely on his findings), and his 14 published articles. We also reviewed and accounted for his research on RNA expression, processing, and participation in the engineering of the genetic code. Based on the information we gathered, we were able to conclude that our client’s investigations contribute to the United States’ energy independence through the optimization of the alternative fuel source known as hydrogenases.

In a bid to present additional evidence to the USCIS, we prompted our client to gather recommendation letters from other experts in the field. We helped him select four independent and dependent recommenders, and incorporated their letters into our client’s EB-2 NIW petition dossier. One of these experts described our client’s work as “… highly significant to both other scientists and citizens across the United States.” Another expert discussed the likelihood of our client continuing to produce important work by stating that “… it is clear that he will continue to produce valuable findings.”  

Case Approval:

We are extremely pleased that the USCIS approved our client’s EB-2 NIW petition—even more so that they did it in merely 2 months and 3 days (on average it takes between 4-9 months). We are currently helping our client put together his I-485 application, and we look forward to helping him attain a green card.
