Case Summary:
Exactly 9 months after we filed an EB-2 NIW (National Interest Waiver) petition on behalf of a research assistant professor from Iran, the USCIS approved her case. At first glance, our client was suitably qualified for the national interest waiver as amongst other things, she possessed a Ph.D. in chemical engineering as well as many years of experience researching the same field.
Assembling a Strong NIW Petition:
Part of the process in getting our client closer to her green card involved presenting her various achievements to the USCIS. These were several of the points we focused on:
- We noted our client’s significant citation record: at the time of filing, she already had 529 citations to her published research. Moreover, she had 43 peer-reviewed journal articles (25 of them first-authored) and a co-edited book , which we highlighted in the petition.
- Our client’s work is concentrated specifically on refining ultrasound-based bioprocesses. Her research in this area is of great importance because it extends the applications of biochar in the production of cleaner energy without damaging soil quality. Her findings on biochar supports initiatives to reduce greenhouse gas emissions and water contamination in the United States. In a nutshell, we clearly demonstrated to the USCIS that our client’s findings have a profound impact in the field of chemical Engineering.
- Of additional significance were the 4 recommendation letters that were signed by our client’s peers, all of which were included in our client’s well planned NIW dossier. One of these letters stated: “[Client’s] superb research contributes greatly to the ongoing efforts of such organizations to improve biofuel production. Indeed, the research we are currently collaborating on has received extensive funding from the National Science Foundation, indicating its significance to the nation.”
