Case Summary:

With a Ph.D. in Chemistry and many years of experience conducting analytical chemistry fieldwork, our client was a suitable candidate for EB-2 NIW (National Interest Waiver). Although he had strong credentials, he needed North America Immigration Law Group (NAILG) to put together a convincing petition dossier for him. Our attorneys and support staff meticulously built a solid case for our client and less than 9 months after it was filed, Nebraska Service Center approved it without issuing a Request for Evidence (RFE).

What did the NIW petition contain?

Our experience has taught us just how important it is to gather as much external support as possible. In this case, we encouraged our client to reach out to his peers and ask for recommendation letters. The four letters that our client returned with served their purpose and contained strong statements such as this: “Researchers around the world have a vast interest in the advancements produced by [Client], and without [Client’s] continued research, researchers in the United States, and the field as a whole, will surely struggle to maintain sustained advancement.”

In addition to recommendation letters, we also documented our client’s 10 publications that had gathered 158 citations at the time of filing. Furthermore, we detailed his research on the instrumentation of mass spectrometry and proved that it directly contributes to environmental protection, food safety, national security, and scientific research across several dependent fields. Additionally, his research efforts developing a high sensitivity and resolution ion mobility spectrometer are contributing to the United States’ ability to detect explosives in airports and other public spaces, as well as conduct precise scientific research.

Filing another I-140 petition:

Our client recently retained our services to prepare and file an EB-1A (Alien of Extraordinary Ability) petition on his behalf. A major benefit to having an approved EB-1A petition is that he can go ahead and file an I-485 application without waiting several years for his priority date to become current (which he has to do as a China-born applicant with an approved EB-2 NIW).
