On February 20th, 2020, we received another NIW (National Interest Waiver) approval for a Postdoctoral Researcher in the Field of Surgical and Critical Care (Approval Notice).

General Field: Surgical and Critical Care

Position at the Time of Case Filing: Postdoctoral Researcher

Country of Origin: Iran

State of Residence at the Time of Filing: Massachusetts

Approval Notice Date: February 20th, 2020

Processing Time: 17 months, 20 days

Case Summary:

North America Immigration Law Group (NAILG) was hired by a postdoctoral researcher from Iran to file his I-140 EB-2 NIW (National Interest Waiver) petition. After waiting for about 18 months, the USCIS finally granted their approval. Not only did we convince the USCIS that our client’s credentials were legitimate, we also reiterated that he is an asset to the United States.

Putting together a personalized NIW petition:

Our goal was to highlight our client’s strengths and skills and convince the USCIS that he deserved the national interest waiver. We did so by presenting an array of his accomplishments such as the 48 times his 9 peer-reviewed journal articles (4 of them first-authored) were cited. We also discussed his work on innovations, developing models and finding solutions to assist in and optimize the standards of care for critically ill patients, trauma injuries, disasters, surgical patients, and surgical emergencies. Based on the comprehensive data that we gathered, we concluded that our client’s research directly contributes to the nation because it improves the standards of care, management and therapeutic interventions for surgical and critical care conditions.

Besides preparing a customized NIW petition, we also gave our client comprehensive advice on a variety of issues related to the I-140. For instance, we helped him select suitable recommenders who could advocate for the approval of his petition. We urged our client to contact these recommenders and ask for letters of support. He returned with 6 signed letters, one of which contained strong statements like these: “[Client’s] research provides American medical professionals with vital information on risk factors for adverse patient reactions to benzodiazepine overdose treatment. This novel work empowers American emergency medicine practitioners to ensure patient safety, provide more nuanced, patient-focused care to overdose patients, and avoid preventable drug reactions and unwarranted patient deaths.”

Besides the service request that we raised on our client’s behalf after the case went beyond the average processing time, everything about our client’s EB-2 NIW case was smooth sailing. Thanks to our insight and experience into how the USCIS adjudicates petitions, we were able to help our client move one step closer to US permanent residency. We congratulate him on this milestone, and wish him the best with his I-485 applications. Seeing that the I-485 application is the final leg of the green card journey, an approval means finally obtaining a green card.
