Case Summary:

An assistant professor from Thailand engaged North America Immigration Law Group’s legal services to help him put together and submit a strong EB-2 NIW (National Interest Waiver) petition on his behalf. Qualifying for the national interest waiver:

Filing an I-485 application while the I-140 petition is pending approval:

What many green card applicants do not realize is that they do not necessarily have to wait for their I-140 petition to be approved before adjusting their status for permanent residence (filing an I-485 application). They can choose to file both simultaneously, file them consecutively, or file the I-485 application while the I-140 petition is pending approval. In this case, our client chose the third option. This enabled him to significantly trim down the overall wait time to receive a green card (he received notification of green card approval less than 2 weeks after receiving his EB-2 NIW petition approval).
