Case Summary:

An assistant professor from Thailand engaged North America Immigration Law Group’s legal services to help him put together and submit a strong EB-2 NIW (National Interest Waiver) petition on his behalf. With two master’s degrees and a doctoral degree under his belt, our client is certainly armed with the educational background to conduct outstanding work that is beneficial to the United States.

Qualifying for the national interest waiver:

To prove that our client qualified for the national interest waiver, we had to highlight his various accomplishments and prove to the USCIS that not many other researchers with similar qualifications can attain the same level of success. Furthermore, we had to establish that our client’s research on the development of novel algorithms, platforms, and tools to meet the rising demand for efficient data mining approaches in medical research is important to the U.S. health care and medical industries. One way we did this was by documenting the 27 citations gathered from his 8 conference and journal articles, 1 first-authored journal article, and 1 U.S. patent.

Fortifying the EB-2 NIW petition:

We also encouraged him to reach out to other experts in the field (whom we helped select) and ask them for recommendation letters. All six of the recommendation letters that our client managed to obtain attested to the value of his work to both the field as well as the United States. Here is what one of these recommenders had to say about our client’s work: “The repeated successes of [Client’s] past and recent work provide a veritable guarantee that he will continue to advance the field as a whole. As such, his continued research presents an opportunity for both the biomedical and data mining research communities in the United States.”

Filing an I-485 application while the I-140 petition is pending approval:

What many green card applicants do not realize is that they do not necessarily have to wait for their I-140 petition to be approved before adjusting their status for permanent residence (filing an I-485 application). They can choose to file both simultaneously, file them consecutively, or file the I-485 application while the I-140 petition is pending approval. In this case, our client chose the third option. This enabled him to significantly trim down the overall wait time to receive a green card (he received notification of green card approval less than 2 weeks after receiving his EB-2 NIW petition approval).
