On April 27th, 2016, we received another EB-2 NIW (National Interest Waiver) approval for a Postdoctoral Associate in the Field of Protein Chemistry (Approval Notice).

General Field: Protein Chemistry

Position at the Time of Case Filing: Postdoctoral Associate

Country of Origin: Ukraine

Service Center: Texas Service Center (TSC)

State of Residence at the Time of Filing: Connecticut

Approval Notice Date: April 27th, 2016

Processing Time: 5 months, 22 days

Case Summary:

Nearly 6 months after we filed an EB-2 NIW (National Interest Waiver) petition on behalf of a prominent postdoctoral associate, Texas Service Center granted their approval. Our client, a Ph.D. holder from Ukraine, hired us because she knew that we would do everything we could to help her get one step closer to a green card. As is apparent by the approval notice, we did not let her down.

Compiling relevant data:

A major part of our job was proving to the USCIS that our client deserved the national interest waiver. We also had to demonstrate that her work in the field of protein chemistry substantially benefits the United States. We built our argument around the fact that our client’s findings are held to very high regard by other researchers who are also progressing the field. For instance, we noted the 61 citations gathered from her 7 publications. We also detailed her research projects on protein modification and characterization and demonstrated their significance in treating colorblindness in the United States. To support our client’s EB-2 NIW case, we needed other influential researchers to give their input, and this was done through recommendation letters. The six experts who contributed letters confirmed the value of our client’s work to the nation, one of whom stated that “It is critical to retain top talents like [Client] to maintain our global leadership in biomedical sciences. Her creative and pioneering work constitutes an important contribution to the advancement and leadership of the United States in the fields of molecular biology and chemistry in addition to visual disorders, spectral tuning, and drug discovery (…) It will be a great loss to our nation if we cannot accommodate such a well-trained, productive, and talented person.”

Receiving petition approval:

Our client chose to file her I-485 application (last step in the green card process) using our comprehensive D.I.Y. Packet. She is currently awaiting favorable news from the USCIS. We wish her the best with this, and thank her for choosing our law firm to represent her EB-2 NIW petition.
