Case Summary:

North America Immigration Law Group (NAILG) was approached by a Moscow-based computational mathematics expert to help him file an I-140 petition from outside the US. Armed with a Ph.D. in Physics and Mathematics coupled with extensive experience in the field of computational mathematics, our client seemed like a good candidate to secure EB-2 NIW (National Interest Waiver) approval. Once we had affirmed his credentials and both parties had agreed to the terms of the contract, we went about building a strong case for him.

Our priority was to highlight his achievements to the adjudicating authorities and to prove that he deserved the national interest waiver. We did this by focusing on his research. Here are some of the details we included in his NIW petition packet:

Research Results:

Our client’s work was focused primarily on semiconductor physics research, heterostructure design and simulations, and advanced mathematical algorithms and software development. We noted that his untiring efforts had led to the development of software for quantum nanostructure simulations, had increased knowledge of semiconductor heterostructures, and had also contributed to the enhancement of advanced imaging techniques and development of artificial intelligence algorithms. The exceptional credentials of our client made it easy to convince the USCIS that his research in the United States will result in vast improvements in national technological capabilities, medical technologies, and cybersecurity measures.

Our client’s remarkable publication and citation record also deserved special mention: at the time of filing, his publications included 31 peer-reviewed scientific articles out of which 15 were first authored, and these had altogether amassed 151 citations. The fact that our client had consistently been invited to present his findings at acclaimed international conferences was also prominently featured in the NIW dossier we prepared.

Recommendation Letters:

It was imperative that we included letters of recommendation into the presentation. Based on our advice, our client managed to secure four such recommendation letters from other highly renowned experts. The words contributed by a physics and astronomy professor read:

“His training as a physicist and mathematician, when considered in conjunction with his demonstrated skill as a computer programmer, clearly differentiates him from his peers. This uncommon combination of skills and experience has enabled him to add to our knowledge while also enhancing the work of many others by developing useful tools and methods that have wide-ranging applications.”

Collectively, all four recommendation letters clearly expressed the benefits of allowing a scientist of our client’s caliber to work in the United States.

Taking the Final Step:

After collecting all the relevant documents, we filed the NIW petition on our client’s behalf. The timeline for adjudication went beyond what we had anticipated (4 to 9 months is the norm for I-140 petitions). We raised two service requests on our client’s behalf and finally received notification of case approval 15 months and 23 days after filing.
