On June 9th, 2017, we received another EB-2 NIW (National Interest Waiver) approval for a Postdoctoral Scholar in the Field of Epidemiological Studies (Approval Notice).

Case Summary:
A postdoctoral scholar from Taiwan secured EB-2 NIW (National Interest Waiver) approval just 70 days after North America Immigration Law Group (WeGreened.com) filed it on his behalf. Adjudicated and approved based on Matter of Dhanasar*, the USCIS clearly agreed with our argument that our client’s research on diseases and their treatment has both substantial merit and national importance; that he is well positioned to advance the field of epidemiological studies; and that on balance, it would be beneficial to the United States to waive the job offer and labor certification requirements.
Not long after we were retained, our client informed us that he needed to secure an employment authorization document (EAD) card within 16 months. An applicant who is filing an I-485 application may also apply for an I-765 (application for EAD) at the same time, which allows him/her to be legally employed in the United States. In order to obtain an EAD card within the requested timeframe, our client needed to file his I-140 petition concurrently with his I-485 and I-765 applications (which he had also retained us to help him with). Our attorneys worked closely with our client to assemble both his NIW petition and I-485 package and filed them simultaneously as soon as they were ready. Our client’s EAD card approved well within the timeframe he had given us, which allowed him to stay employed in the US.
