Success Stories: Thanks to our Unique Legal Strategy, an Iranian Research Assistant Professor in the Field of Environmental Physics Obtains NIW Approval

Client’s Testimonial:

“Thanks for all your efforts on my case! It was a good experience working with the Chen group.”

On January 5th, 2018, we received another EB-2 NIW (National Interest Waiver) approval for a Research Assistant Professor in the Field of Environmental Physics (Approval Notice).

General Field: Environmental Physics

Position at the Time of Case Filing: Research Assistant Professor

Country of Origin: Iran

State of Residence at the Time of Filing: Utah

Approval Notice Date: January 5th, 2018

Processing Time: 14 months, 16 days

Case Summary:

After a long wait (14. 5 months), a research assistant professor from Iran finally received notification of EB-2 NIW (National Interest Waiver) approval. Despite our best efforts, the USCIS issued a Request for Evidence (RFE). Our team promptly responded to it and despite the long wait, our client is finally one big step closer to US permanent residency.

What did the customized NIW petition packet contain?

For one, we noted our client’s Ph.D. in Agricultural Engineering and his various projects on the development of physical models simulating soil water flow, heat/mass transport, and electromagnetic wave propagation across land surfaces. We worked diligently to persuade the USCIS that our client’s research efforts are contributing to the United States’ environmental monitoring programs.

We also focused on highlighting our client’s strengths. As part of our comprehensive services, we built a personalized NIW petition that shed light on his various accomplishments. For instance, we listed the 74 times his 21 publications were cited, and well as the 20 times he had assessed the work of his peers for several scientific journals. We also engaged the help of other experts working in the field of environmental physics by including recommendation letters signed by several of our client’s peers. These letters supported our argument our client’s substitution with another minimally qualified researcher would adversely affect the national interest of the United States. As an example, this is what one of our client’s recommenders noted in his letter: “Overall, [Client] is internationally recognized as a researcher with impressive ability. His outstanding expertise in environmental soil physics places him in the top-tier of researchers in this field.”

Securing petitions approval:

We are pleased that our client received the national interest waiver. We congratulate him for overcoming this major hurdle in the green card journey, and we wish him the best as he files an I-485 application with the help of our DIY Packet.
