Case Summary:  

In the fast-moving world of next-generation wireless networks, the client, a computer engineering researcher with an M.S. in electrical engineering, is advancing technologies that make it possible to test and validate 5G and emerging 6G systems in realistic, large-scale environments. With support from North America Immigration Law Group (NAILG), the client’s I-140 EB-2 NIW (National Interest Waiver) petition was carefully prepared and ultimately approved, reflecting both the national relevance of the proposed endeavor and the strength of the evidentiary record.

Transforming Rural Connectivity Through Programmable Wireless Testbeds

The client’s proposed endeavor is to continue developing, optimizing, and implementing large-scale, programmable wireless testbeds to advance next-generation wireless networks, including 5G/6G and Open RAN systems. In the petition, we framed this work as important because high-quality testbeds are foundational infrastructure for wireless innovation. They allow researchers and engineers to evaluate performance, reliability, interoperability, and deployment feasibility before technologies are adopted at scale.

We also emphasized how this endeavor supports meaningful national priorities, including strengthening rural broadband connectivity and enabling ultra-reliable low-latency communication (URLLC). Rather than relying on broad claims, we explained that practical testbeds help accelerate real-world deployment pathways by making next-generation wireless systems more measurable, reproducible, and deployable in challenging environments.

Establishing a Record of Research Excellence

We emphasized objective indicators of expertise, influence, and peer trust. At the time of filing, the client had produced 10 peer-reviewed conference articles, including 4 first-authored papers, as well as 3 preprints, of which 1 first-authored preprint. The client’s publications have been cited 33 times.

We did not present these numbers as automatically sufficient. Instead, we explained how an adjudicator could reasonably interpret them in context for computer engineering, where peer-reviewed conference publications often represent highly selective, field-defining research dissemination. We also highlighted that at least three of the client’s papers ranked among the most highly cited in the broader Computer Science category for their respective publication years, including one paper in a top citation percentile tier. We presented this as evidence of independent reliance, showing that other researchers are using the client’s work to inform and validate their own investigations.

The petition also documented that the client has completed at least 14 peer reviews. We framed this as selective professional recognition because reputable venues typically invite reviewers who have demonstrated specialized expertise and the judgment required to evaluate others’ research for rigor and novelty.

To further support the national-importance narrative, we included evidence of major funding sources connected to the client’s research direction, including support from the National Institute of Food and Agriculture and the National Science Foundation. This funding history helped reinforce that the underlying work aligns with competitively supported priorities tied to U.S. connectivity and wireless innovation.
