On March 30th, 2021, we received another EB-2 NIW (National Interest Waiver) approval for a Senior Research and Development Engineer in the Field of Computer Engineering (Approval Notice).

Case Summary:

North America Immigration Law Group was approached by a senior research and development engineer holding a Ph.D. in computer engineering to support him file an I-140 NIW petition on his behalf. Based upon his accurate qualification and experience, he deserved to acquire the NIW petition approval. When he provided us with all of his credentials, we consented to take his case ahead and countersigned the terms of the client-attorney contract.

According to the matter of Dhanasar (The analytical framework for assessing eligibility for National Interest Waiver), the USCIS needed the following information in our client’s petition packet:

  • The foreign national is a member of the professions holding an advanced degree;
  • The foreign national proposed endeavor has both substantial merit and national importance;
  • The foreign national is well-positioned to advance the proposed endeavor; and
  • On balance, it would be beneficial to the United States to waive the requirements of a job offer and thus of a labor certification.

We began establishing a strong case for him and to convince USCIS that our client is an exemplary researcher and must continue his research work here in the United States, we recorded the impressive accumulation of 227 citations from 20 peer-reviewed journal and conference articles (10 of them first-authored) he published. Moreover, these writings have been published in the topmost publications in our client’s field, which highlights his peers’ recognition of the significance of these research works. We also noted the 10 times our client appraised the work of his peers.

Most importantly, we elaborated his intended research on developing high-level techniques for the automatic synthesis of integrated circuits and how it has great importance because efficient integrated circuits are essential to the recent advancements in telecommunications, internet technology, and consumer electronics. We deduced that his research primarily focused on optimizing synthesis techniques and, in his well-cited works, he has provided proven methods of synthesis that not only reduce the area of the circuits produced but have been shown to produce those circuits more quickly.

We built the case with all the required documents; however, it was crucial for us to incorporate the letters of recommendation. Accordingly, our client obtained two letters from the other distinguished experts in the same field providing additional insight into his work which has significant substantial merit and the widespread influence his work has on the field of computer engineering. Not only do his algorithms and methodologies stand out as premier examples in the scientific literature but they are also beneficial in comparative studies.
