“I am extremely thankful for all support that you/your team extended to me.”

On April 1st, 2021, we received another EB-2 NIW (National Interest Waiver) approval for a Researcher in the Field of Molecular Oncology (Approval Notice).

General Field: Molecular Oncology

Position at the Time of Case Filing: Researcher

Country of Origin: Nepal

State of Residence at the Time of Filing: California

Approval Notice Date: April 1st, 2021

Processing Time: 10 months, 13 days

Case Summary:

A researcher approached North America Immigration Law Group for filing an NIW (National Interest Waiver) petition on his behalf. Our client held a Ph.D. in molecular oncology. His knowledge, experience, expertise, and documented report of achievements have altogether made him an ideal candidate for the EB-2 NIW petition. Part of our job was to persuade USCIS that his research is nationally important and to highlight the use of his innovative methodologies and the essence of his breakthroughs. Hence, we included the following details in his NIW petition packet:

1) We detailed his research on identifying novel genes and genetic pathways to support the development of advanced prognostic and therapeutic methods for metastatic cancer, particularly glioblastomas and brain, breast, and lung cancers. After a complete review, we concluded that as cancer is a widespread disease in the United States, our client’s research is certainly of great importance because it is relevant to the treatment of metastatic cancer and the reduction of cancer mortality in the United States.

2) Also, we recorded that his publications accumulated 183 citations, confirming the great impact of his widespread recognition as a leading authority in the field of molecular oncology, and his publications included 6 peer-reviewed journal articles including two first authored publications. These papers have been published in the top journals in his chosen field, reflecting his peers’ appreciation of his work. His expert peers have directly utilized his models, referred to his work, and listed his findings as essential for others to look to for a greater understanding.

To further verify our client’s provided declarations, we advised him to reach out to other experts in the field for supporting his case, and successfully, he obtained two recommendation letters, adding more insights into the merit of his research work.

Our unique strategies were once again proved successful as we were able to convince USCIS of our client’s intent to continue researching cancer epigenetics, and we also stated how he has applied to several research positions at various U.S. institutions; thus, he is a valuable resource to the United States.

We are glad that our client received his NIW approval within 10 months and 13 days without any further request for evidence from USCIS. We thank him for associating with us and congratulate him on this great milestone.
