Success Stories: We Contrived a Unique NIW Petition, Helping A Postdoctoral Research Associate from Pakistan to Secure the Approval

Client’s Testimonial:

“Thank you very much for all your help. Great news about the NIW approval! You guys have been amazing.”

On April 19th, 2021, we received another EB-2 NIW (National Interest Waiver) approval for a Postdoctoral Research Associate in the Field of Electrical Engineering (Approval Notice).

General Field: Electrical Engineering

Position at the Time of Case Filing: Postdoctoral Research Associate

Country of Origin: Pakistan

State of Residence at the Time of Filing: New Jersey

Approval Notice Date: April 19th, 2021

Processing Time: 13 months

Case Summary:

Our client, a postdoctoral research associate holding a Ph.D. in electrical engineering exhibited the capabilities to obtain the national interest waiver. He approached North America Immigration Law Group to help him in filing an EB-2 NIW (National Interest Waiver) petition to demonstrate his progressive research on designing improved computer algorithms, next-generation imaging systems, and optical sensor systems to speed up information delivery in smartphone cameras, autonomous vehicles, and 3D biological imaging. Thus, we evaluated his research and concluded that it is of great importance because it improves camera technology beyond what is currently available in the market. Contributions to the global camera market are invaluable for ensuring U.S. economic leadership.

As a part of our job, we devised a convincing petition packet to establish how our client’s research is valuable to the technology, automobile industries, and the medical field, thereby benefiting U.S. industries and consumers. We incorporated the following details in his petition packet and submitted them to the USCIS for further adjudication of the case.

  • Firstly, we noted that his research has substantial merit as cameras are now ubiquitous, and enhancing their capacity benefits many stakeholders. His new approaches to autofocus techniques have overcome some of the most troublesome issues, and with the techniques, industrial camera designers are now better equipped to manufacture cameras with superior autofocus performance. This, in turn, benefits the multi-billion-dollar global smartphone market as well as consumers in the United States and around the globe.
  • The importance of his intended investigation is further corroborated by other specialists in the field. Four of his fellow experts assisted him by signing the recommendation letters. Therefore, it was necessary for us to get the letters attached, and here is one of the excerpts contributed by one of his recommenders:

“Cameras are increasingly found in almost every type of modern electronic equipment. Consumer demand dictates that electronics manufacturers ensure that the cameras in their products are of the highest quality possible. [Client’s] research improving camera design and performance supports the commercial goal. Moreover, his skills are such that he is also improving the imaging systems that support a variety of microscopy instruments for imaging various biological structures. In this facet of his research, he is optimizing the tools used by researchers in areas such as molecular biology and genomics, and his work in this realm has unquestionable relevance to efforts to better understand the human body at more minute scales than ever before possible.”

  • Besides, we recorded our client’s publications which have been cited 90 times from 11 peer-reviewed journal articles (5 of them first-authored) and 7 peer-reviewed conference articles (3 of them first-authored). Further, he has conducted 10 peer-reviews for highly acclaimed journals. Hence, the aforementioned facts confirm that he is highly acknowledged in the electrical engineering field and well-positioned to advance the proposed research work in the U.S.

We are overwhelmed that our persistence in our client’s case bore prolific results. The USCIS spent 13 months adjudicating his case and granted the NIW approval without any request for additional evidence. We thank him for trusting us with his NIW case preparation and allowing us to be a part of this successful journey.
