Success Stories: Based on the Matter of Dhanasar, A Postdoctoral Fellow from China Secured NIW Petition Approval in the Field of Molecular Biology

Client’s Testimonial:

“Thank you for your valuable help. It is your work that got my case approved.”

On February 5th, 2021, we received another EB-2 NIW (National Interest Waiver) approval for a Postdoctoral Fellow in the Field of Molecular Biology (Approval Notice).

General Field: Molecular Biology

Position at the Time of Case Filing: Postdoctoral Fellow

Country of Origin: China

State of Residence at the Time of Filing: Texas

Approval Notice Date: February 5th, 2021

Processing Time: 11 months

Case Summary:

We filed an I-140 NIW (National Interest Waiver) petition on behalf of a postdoctoral fellow from China and USCIS adjudicated the case for 10 months and 21 days based on the (Matter of Dhanasar*). Successfully, our client was granted approval without any further evidence (RFE).

To make our client achieve this NIW success, we took the following steps:

1) Evaluation of our client’s credentials and research: We explored that he held a Ph.D. in biochemistry and molecular biology, undoubtedly, he exhibited the ability to advance his research in molecular biology. Moreover, he has significant experience researching in the field, focusing on the molecular mechanisms of the human cell metabolism to determine the pathology of metabolic diseases and cancer and develop novel clinical treatments for these diseases. We deduced that his research is of great importance because it offers invaluable insights into the inner mechanisms of several processes in cell metabolism, which is a vital concept in both molecular biology and the treatment of diseases like cancer.

2) Underlining his Publication & Citation Record: We noted that his publications have been cited 71 times from the four peer-reviewed journal articles (1 of them first-authored) he published, maintaining the constant productive publication rate, and proving his influence in the field of molecular biology. Besides, his papers have received remarkable recognition from the scientific community. He has approximately 65 citations originating from all around the globe. The international citations imply the widespread pertinence of his research, confirming that researchers from many countries have actively sought out his work.

3) Additional Support: To corroborate the provided documentary evidence by our client, we added further testimonials acquired from other experts in the field. Five of the well-known researchers obliged to sign and support our client’s work and how he must continue his research here in the United States, which clearly has substantial merit and national importance.

“More than just providing this invaluable information, [client] has provided new therapeutic targets for his fellow researchers. Without his research, those working in the field of biomedical sciences would have a much more limited understanding of this complicated interplay.”

We are ecstatic that our client received the EB-2 approval and congratulate him on this victory. We thank our client for choosing North America Immigration Law Group to represent his NIW application. We wish him a bright future with his proposed endeavor.

Matter of Dhanasar* (issued on December 27, 2016) is the new analytical framework to assess eligibility for NIW, replacing the old three-prong test set by the overturned precedent NYSDOT.
