Case Summary:

Just 3 days after North America Immigration Law Group (WeGreened.com) filed an EB-1A (Alien of Extraordinary Ability) petition on behalf of a research associate from China, the USCIS issued an approval notice. Although the short adjudication timeline was thanks to Premium Processing (PP), we have no doubt that our customized EB1A petition packet paved the way for case approval.

Knowing our client’s strength:

As part of our winning legal strategy, we carefully evaluated our client’s credentials to determine if he qualified for EB1A. We took a close look at his various achievements and concluded that he could claim 3 out of the 10 EB1A criteria set by the USCIS. We selected these criteria because they gave our client the highest chance of securing EB1A petition approval.

The 3 criteria were:

  1. Authorship of scholarly articles: Our client’s research has led to the publication of 18 peer-reviewed articles, all of which were published in prominent scientific journals. As these journals are extremely selective, our client’s impressive publication record is an accomplishment achieved by only the very best researchers in the field.
  2. Judge of the work of others: By the time we were ready to file our client’s EB1A petition, he had already conducted 44 peer reviews for a variety of scientific journals. This proved that our client is one of a small percentage who has risen to the very top of his field and has sustained both national and international acclaim.
  3. Original contributions of major significance to the field: We used Google Scholar to determine the number of citations gathered from our client’s work. At the time of filing, these numbers stood at 151 citations, proving that our client had contributed immensely to his field of pathology.
All the information we gathered was used to persuade the USCIS that our client’s work on infectious diseases is extremely important to the United States. We tailor-made the EB1A petition to demonstrate that our client’s research is particularly original, especially with applications such as the development of diagnostic methods for livestock pathogens. We also included recommendation letters contributed by other influential pathologists, one of whom noted: “These academic and work experiences, combined with his inherent talents, have made [Client] one of the world's most notable experts in molecular microbiology, infectious disease, and pathology.”

We are pleased that our effective legal strategy led our client closer to his green card. We congratulate him for securing EB1A approval and thank him for retaining our I-485 services.
