On April 12th, 2021, we received another EB-2 NIW (National Interest Waiver) approval for a Postdoctoral Fellow in the Field of Cell Biology (Approval Notice).
General Field: Cell Biology
Position at the Time of Case Filing: Postdoctoral Fellow
Country of Origin: India
State of Residence at the Time of Filing: Wisconsin
Approval Notice Date: April 12th, 2021
Processing Time: 7 months, 14 days
Case Summary:
North America Immigration Law Group was contacted by a Wisconsin-based postdoctoral fellow from India to assist him to file an EB-2 NIW (National Interest Waiver) petition. He held a Ph.D. in biotechnology, intending to continue his research on the identification of therapeutic targets for the development of treatments for cardiovascular and neurodegenerative diseases. We appraised his research and concluded that it aims to develop new target-based therapies for cardiovascular and neurodegenerative diseases, both of which are among the top ten causes of death across the globe. Thus, we established that his credentials were suitable enough to deserve the national interest waiver petition approval.
We agreed to countersign the client-attorney relationship agreement, and we prepared an extensive petition packet presenting our client’s case. We began with his detailed research and its great importance and noted that he also acquired 5 recommendation letters signed by other substantial researchers in the field of cell biology, fortifying his recognition and significance of his work within the United States. One of his recommenders stated:
“[Client’s] research, which addresses the factors and pathways contributing to inflammation, is thus widely valuable to U.S. public health. Addressing inflammation is key to mitigating the impacts of clinical conditions because most of the anti-inflammatory mechanisms are not completely understood which is very much essential in developing therapeutic drugs for patients with clinical conditions. The United States must extend him the support he needs to continue this crucial research unimpeded.”
Besides, we recorded the 21 citations accumulated from the 7 peer-reviewed journal articles (2 of them first-authored), 3 conference publications (2 of them first-authored), and 1 accepted article he published in outstanding journals. Not only has his research been accepted for publication in such elite journals, but it has also been cited no fewer than 20 times to date. Also significant is the fact that these citations come from institutions as far afield as China, Russia, and France. His influence is apparently international in scope. Moreover, these peer-reviewed articles demonstrate that he has generated high-quality scientific scholarship that has been recognized by his fellow scientists, and this rate of citation cements his role as an influential researcher whose work has been beneficial to the subsequent research of his fellow scientists. Additionally, he has conducted 9 peer reviews to date, which proves he has an elevated degree of expertise for the role of a peer reviewer as well.
Upon adding copies of his Ph.D. diploma, transcript, and degree evaluation and the employment letter confirming his current position and indicating that funding for his work is expected to continue in the field, we highlighted the significance of his contributions and his record citations that establish him as a highly influential researcher whose work has had a profound effect on the attempts of other researchers, not only in cell biology but in other related fields in the United States. After submitting his I-140 NIW petition to the USCIS, exactly 7 months and 14 days after the case was granted approval. Therefore, we thank our client for choosing our law firm for his I-140 case presentation. Also, we congratulate him on this grand breakthrough.
