Case Summary

With multiple years of experience working in the field of plant sciences, our client—a postdoctoral researcher from India—seemed to be a suitable candidate for EB-1A (Alien of Extraordinary Ability). Before initiating the contract, we conducted a thorough evaluation of his credentials to be absolutely certain, and as it turns out, we were right.

EB-1A Petition:

It is no secret that EB1A is upheld by a high standard of law and that not many petitioners qualify for this visa category. Thus, in order to convince the USCIS to approve our client’s EB-1A petition, we needed to be extremely meticulous in our presentation of his various accomplishments. We could not leave any stone unturned, and we had to thoroughly prove that our client’s presence in the United States would continue benefitting the country. Here are some of the key points that we presented to the USCIS:

  1. Research Projects: Our client’s work in the field of plant sciences focuses on the role of microbes in rice cultivation, and, more broadly, on crop protection and improvement. His work advances our understanding of how to increase the health and yield levels of important commercial crops. We reviewed our client’s investigations and proved to the USCIS that his findings are extremely beneficial to the U.S. agricultural sector.
  2. Proof of Utilization: By detailing our client’s 18 journal articles, two books, the 147 citations to his work, and the 20 times he conducted peer reviews for well-known journals, we proved that his opinions are highly sought after and utilized by other scientists to progress their research.
  3. Strong Support: We understood the significance of unbiased third-party support, and urged our client to contact other experts in his field of plant science. We needed him to request them to contribute recommendation letters that stated the importance of his work to the field, as well as to the country. Six experts agreed to lend their support, one of whom stated that “I would like to reiterate the high value of [Client’s] research and its uniquely essential nature. As a highly accomplished scientist residing at the pinnacle of his field, he has time and again made contributions of inestimable value to the field. It would be a tragic loss, both to the plant sciences/molecular biology field and to the scientific community in general, were [Client] to be unable to continue his work in this country. I can state with absolutely certainty and veracity that his work is needed to continue the advancement of our field.”
Thanks to Premium Processing, we received an approval notice merely a week after we filed the EB-1A petition on our client’s behalf. We would like to congratulate our client on this milestone. Approximately a month ago, we helped him and his spouse file their I-485 applications. This is the final step in the green card process and once the USCIS approves their applications, they will receive their green cards. We join them as they await a positive outcome from Nebraska Service Center.
