Case Summary:

The average processing time for I-140 cases is 4-6 months. But on many occasions, we have cases approved far faster than the average processing time.

Recently at Chen Immigration Law Associates we received a National Interest Waiver approval for a client from Hong Kong. This client is a molecular biology postdoctoral research fellow with a particular emphasis on the treatment of cancer and genetic disorders. His work has focused primarily on exploring the mechanisms and signaling pathways of DNA repair and damages responses, generally using yeast DNA as a model. In order to ensure the success of this case, we submitted extensive documentation of the client’s highly significant contributions to the field of molecular biology. Our client’s work has resulted in at least 4 peer-reviewed scientific articles published in leading journals in the field and 1 conference presentation. Additionally, his publications have been cited at least 36 times by researchers all around the world from prestigious institutions. Our firm drafted and submitted several recommendation letters from experts in our client’s shared field. One of the leading researchers in the field said the following concerning our client’s expertise, “I am able to unequivocally state that [the Petitioner] has a gift for conducting research projects that involve designing and performing comprehensive experiments in order to resolve critical scientific questions.” With the strong petition letter and recommendation letters we prepared, our client’s NIW case was approved in just 5 weeks without RFE.
