Case Summary:

A senior chemist from China hired North America Immigration Law Group (NAILG) to help him obtain an O1-A (Individuals with Extraordinary Ability or Achievement) visa. In order to receive notification of case approval, he needed to show that he was an individual with extraordinary ability who was temporarily entering the United States to continue work in his area of specialization. With our help, our client accomplished this goal and received petition approval in just 3 months, despite RFE. Our vast experience dealing with employment-based visa petitions armed us with the perfect legal strategy to secure our client’s O1A petition approval.

Before we started work on the case, we conducted a thorough evaluation of our client’s credentials to verify his chances of O1-A approval. We confirmed that he held a doctoral degree in chemistry with a focus on polymer development and application, and that he had extensive research experience in the field of chemistry. We also determined that our client was an expert in the development of several novel BPAs with improved electronic delocalization abilities. His research addresses some of our nation’s most pressing issues in understanding organic solar cells and light-emitting diode devices for energy sustainability.

Our client’s O1A petition packet also detailed his citation and publication record. At the time of filing, our client’s publications included 6 peer-reviewed scientific articles that had accumulated 83 citations. Moreover, our client had been invited by several high-impact journals to review the work of his peers in the field. Our client had already conducted 5 reviews when we filed his case. This was proof of his important standing amongst other experts specializing in his field.

To validate the extent of international influence his work had garnered, our client procured five letters of recommendation signed by top-level experts from home and abroad. One of the recommenders stated: “[Client’s] more than 10 years of experience in the field has fashioned him into a particularly skilled researching chemist. [Client] quickly rose to the forefront of his field and performs research that is heavily geared toward practicality and usability. The research community of the United States would therefore be at a distinct disadvantage without his insights regarding the synthesis of novel conjugated polymers and monomers and other contributions to the field.” These letters, which were incorporated into our client’s O1-A petition dossier, amply endorsed our client’s credentials.

After months of diligent work, we successfully demonstrated that our client had satisfied the O1A criteria. The reason why it took a little longer than the expected is because the petition was issued a Request for Evidence (RFE). As part of our comprehensive services, we efficiently responded to the RFE and cleared all the doubts regarding our client’s credentials. The approval of this petition is yet another example of our firm’s excellent record of helping our clients secure I-129 approval. We thank our client for selecting us to represent his O1-A case and wish him the best as he continues to advance the field of chemistry with his impactful research.
