Case Summary:

Over a year after North America Immigration Law Group (NAILG) filed an EB-2 NIW (National Interest Waiver) petition for an associate professor based in her birth country of Iran, the USCIS approved her petition. Although it took them over a year to adjudicate our client’s case, we are pleased that it was approved without the issuance of a Request for Evidence (RFE). We have no doubt that our detailed presentation of our client’s strong credentials paved the way for petition approval. These are some of the points we focused on:

  1. Research Results: In order to prove to the USCIS that our client deserved the national interest waiver, we first had to carefully understand her research. After studying the research summary which she provided us, we were able to conclude that our client contributes to the United States’ pharmaceutical industry via the creation of novel drug therapies for the millions of individual who suffer from cancer. Not long after we advised our client to do so, she returned with four letters, one of which contained this strong statement made by a respected professor: “The prudent course of action is to permit [Client] to work in the U.S. As I have stated before, her research is integral to improving patient survival rates and lessening the adverse side effects of chemotherapy. In the absence of her laudable research, the fields of inorganic chemistry and medicine both suffer.”
  4. Additional Evidence: Supporting evidence such as our client’s CV, a statement regarding her future research plans, and a copy of her doctoral degree were also incorporated into her NIW petition packet.
Undergoing Immigrant Visa Processing (IVP):

IVP is the final step in the green card process for applicants who do not reside in the US. As there is no US embassy/consulate in Iran, Iranians must undergo IVP at one of the following US embassies: Ankara, Turkey; Abu Dhabi, UAE; or Yerevan, Armenia.
