On December 18th, 2019, we received another NIW (National Interest Waiver) approval for a Postdoctoral Associate in the Field of Biomedical Engineering (Approval Notice).

General Field: Biomedical Engineering

Position at the Time of Case Filing: Postdoctoral Associate

Country of Origin: Germany

State of Residence at the Time of Filing: North Carolina

Approval Notice Date: December 18th, 2019

Processing Time: 14 months, 8 days

Case Summary:

A postdoctoral associate engaged North America Immigration Law Group (NAILG) to help him file an EB-2 NIW (National Interest Waiver) petition. At first glance, his doctoral degree and extensive experience in the field of biomedical engineering made him a suitable candidate for EB-2 NIW. After carefully evaluating his credentials to be sure that we build a strong case, we determined that he qualified for the national interest waiver.

Part of our services included helping our client select influential experts who could contribute strong recommendation letters in support of his EB-2 NIW petition. We carefully examined these fellow experts and researchers to make sure that they were familiar with our client’s work. Their letters advocated for the approval of our client’s EB-2 NIW petition and served as strong evidence to support his case. To quote one of the recommenders: “[Client’s] research has helped improve the energy efficiency and accuracy of magnetic stimulation coils, which in turn has facilitated the production of portable or at-home magnetic stimulation coils to reduce the cost of this valuable treatment method for patients with depression and other mental health conditions.”

Accompanying these recommendation letters were details on client’s 7 peer-reviewed scientific articles (all of them first-authored), 3 book chapters (2 of them first-authored), the 26 citations gathered from his work, and his experience of judging the work of his peers for 18 times, which demonstrate our client’s role in the scientific community as a peer reviewer for highly acclaimed journals and conferences. We also reviewed his work on the development of neural stimulation and modulation techniques. His research in this area of expertise is of great importance because it contributes to the development of novel treatments for depression, neurodegenerative disorders, and a plethora of physical disorders, including chronic pain.

Despite waiting 14 months and 8 days, our client finally secured NIW petition approval. The reason why it took longer than the expected 4-9 months is because the petition was issued a Request for Evidence (RFE). As part of our comprehensive services, we efficiently responded to the RFE and cleared all doubts regarding our client’s credentials. The approval of this petition is yet another example of our firm’s excellent record of helping our clients secure I-140 approval. We thank our client for not only selecting us to represent his NIW case, but also retaining us for his I-485 applications.
