General Field: Civil Engineering

Position at the Time of Case Filing: Assistant Professor

Country of Origin: Iran

Service Center: Nebraska Service Center (NSC)

Approval Notice Date: September 12th, 2016

Processing Time: 8 months, 20 days

Case Summary:

Nearly 9 months after North America Immigration Law Group (NAILG) filed an EB-2 NIW (National Interest Waiver) petition for an assistant professor based in Iran, the USCIS approved his petition. We are pleased that our client’s work on developing and improving techniques for designing and analyzing physical structures in the field of civil engineering convinced the USCIS that he is an asset to the United States.

With a Ph.D. in Structural and Earthquake Engineering and many years of experience progressing the field of civil engineering, our client was a suitable candidate for EB-2 NIW. Furthermore, the various results of his research lent a hand in securing petition approval. We noted his publication record and citation count, which at the time of filing stood at 15 peer-reviewed journal articles and 212 citations. We also detailed the 20 times he was invited to judge the work of his peers.

To further fortify our client’s petition, we incorporated recommendation letters volunteered by other influential members of the civil engineering research community. We helped our client narrow down this list and suggested that he only approach experts who are familiar with his research. The four experts whom our client approached agreed to advocate for the approval of his EB-2 NIW petition, and one of them noted that our client’s work “…is essential to the forward progress of his scientific field. Consequently, halting his work would have negative consequences that would be felt throughout the scientific community.”

We congratulate our client for obtaining the national interest waiver, and we wish him the best as he and his dependents undergo Immigrant Visa Processing.

What is Immigrant Visa Processing (IVP)?

Only applicants who are based in the US can adjust their status for permanent residence by filing an I-485. For applicants living abroad, they must undergo IVP. In a nutshell, applicants will pay the fees and submit the relevant paperwork before attending an interview (with their dependents) at the proper American embassy or consulate. Assuming everything goes well, our client and his family will each be issued an immigrant visa which they will then use to enter the US as permanent residents. Their green cards will subsequently be mailed to their US address. To find out more about IVP, please head to http://www.wegreened.com/Immigrant-Visa-Processing?title=Consular-Processing
