Case Summary:

A Vietnamese computer science expert hired North America Immigration Law Group (WeGreened.com) to help him file an I-140 petition. Holding a Ph.D. in Computer Science and vast experience in the field, our client seemed like a sure candidate to receive EB-2 NIW (National Interest Waiver) approval. After ascertaining the strength of his credentials, we countersigned the retainer agreement.

As part of our services, we highlighted our client's achievements and established why he deserved the national interest waiver. The following are some of the details we included in his NIW petition packet:

- We discussed the various contributions made by our client in the field of computer science, especially on real-time distributed systems, sensor networks, big data, and deep learning. We emphasized how his research optimizes resource usage of critical computing system used in avionics system, military systems, and medical devices. Needless to say, our client's research efforts are strengthening high-tech business sectors in the United States while also ensuring the health, safety, and wellbeing of the general public.

- Our client's remarkable publication and citation record also deserved special mention: at the time of filing, his publications included 9 peer-reviewed scientific articles which had amassed 187 citations. The fact that our client had consistently been invited to review papers at acclaimed international conferences and for highly reputable journals was also prominently featured in the NIW dossier we prepared.

- As part of our legal strategy, we include letters of recommendation into the presentation. Based on our advice, our client managed to secure 4 such recommendation letters from other renowned experts. These words contributed by a professor of computer engineering are especially noteworthy:

“It is clear that [Client's] contributions to computer science are of paramount importance to effective, real-time communications and major commercial operating systems, and that he is inimitably well-qualified to continue in his transformative research."

Collectively, all 4 recommendation letters clearly expressed the benefits of allowing a scientist of our client's caliber to work in the United States.

After collecting all the relevant documents, we filed the NIW petition on our client's behalf. The timeline for adjudication went beyond what we had anticipated (4 to 9 months is the norm for I-140 petitions). We raised a service request on our client’s behalf and finally received notification of case approval 10 months and 29 days after filing.

As our client currently resides in the US, he will embark on the final leg of the green card journey by filing I-485 applications for himself and his spouse (the other option involves undergoing immigrant visa processing for applicants who live outside the US). We thank them for retaining our I-485 services and look forward to helping them secure green card success.
