Case Summary:

With a Ph.D. in computer science and applications and substantial research experience, unquestionably, our client possesses the ability to advance in the field of computer science. When he contacted our law firm to file an I-140 NIW (National Interest Waiver) petition on his behalf, we looked more into his professional and academic degrees, and after thoroughly assessing his credentials, we confirmed that we would guide him towards NIW success and hence countersigned the retainer agreement.

To prove that he is a fundamental researcher in his field of endeavor, we incorporated key essentials to his NIW (National Interest Waiver) petition packet. We noted that his work has been cited 84 times by dependent and independent researchers, demonstrating that his publications are widely acknowledged and counted upon in the field of computer science. We even detailed his contributions to peer-reviewed conference articles which resulted in 20 peer-reviewed conference papers (16 of them first-authored) and 3 peer-reviewed journal articles (2 of them first-authored). Moreover, we discussed that our client has been regularly invited to conduct peer review for elite journals and conferences in the field due to his knowledge and expertise in cybersecurity, data security, and artificial intelligence. He has completed at least 4 peer-reviews to date. Since only the most highly esteemed researchers in the field are requested to assess the work of their peers, especially in authoritative journals, evidently our client is seen as very knowledgeable and scholarly in his field.

Furthermore, our client’s work related to mobile device security has great substantial merit and national importance. Among other applications, his research is relevant to cybercrime prevention, smartphone development, and various applications of remote sensing including health care and vehicular safety. His research provides novel tools that enhance data security on mobile devices without sacrificing user experience. He has also developed novel evaluation frameworks that enable users to assess their phones for security risks and implement solutions. His work thus, to expand this growth using data security tools helps sustain economic development and meet consumer demands.

To bolster our client’s case further, we added recommendation letters signed by four other expert scholars in the field, two of whom stated:

“[Client’s] work on using machine learning for human activity recognition is particularly beneficial for the United States...As the leading cause of death in the US is heart disease, with diabetes close behind, it is crucial that we find more effective methods of treating these conditions. [Client’s] research provides a key contribution to this end, utilizing machine learning and artificial intelligence methods in combination with sensor technology to improve activity recognition software.”

“[Client] has also seen his work appear in a number of leading publications and conference venues…Given their prestige, it is no small feat that [client’s] work has been featured in these venues, this record further illustrates the high quality of his research output. Clearly, [client’s] expertise and work are in high demand.”

Furthermore, due to its clear national importance, his research has been supported with funding from:

  • The National Science Foundation,
  • Department of Homeland Security,
  • The National Security Agency, and
  • The United States Military Academy
This funding is reserved solely for research directed at advancing the national interest, including research that advances basic scientific research, protects privacy and communication networks, and defends the nation from security threats. Thus, it is clear that our client’s work relating to data security has immense importance for national defense and for general technological progress, particularly in the area of mobile phones and software development.

We are pleased that our efforts and hard work, in this case, paid off well in proving that our client’s major contributions to the field of computer science make him an irreplaceable asset to the United States, thus he received his NIW (National Interest Waiver) approval. He even achieved his I-485 approval with our continuous assistance. Therefore, we thank him for choosing the North America Immigration Law Group to represent his case and wish him very well as he continues to advance in his proposed field.
