Case Summary:

With a Ph.D. in nuclear and radiological engineering, an assistant professor contracted with our law firm to help him to file an I-140 NIW (National Interest Waiver). Meanwhile, waiting for NIW approval, he also asked us to file another petition on his behalf under the EB-1A (Alien of Extraordinary Ability) visa category. It is very common to file more than one petition to push forward the adjudication process and reach closer to achieving green card success. Despite NIW and EB1A are two unique visa categories, we have managed several employment-based immigrant visa petitions, thus, we were sure of outstretching the rational expectation that our client can pursue further in the proposed field here in the United State, and we underlined the array of appropriate information in his NIW and EB1A cases:

  • We noted his research has provided the field with methods to significantly reduce the radiation dose associated with obtaining high-quality medical images and thus is a major advance that benefits public health. 1631 times his publications were cited, proving it of clear value for the ongoing development of the field and has been widely recognized in at least 26 countries. We also specified that he was regularly invited to adjudicate the work of peers 40 times, proving his active and actual participation as a judge of the work of other experts in the field.
  • Besides, we highlighted the 49 peer-reviewed journal articles (13 of them first-authored or co-first authored), 22 peer-reviewed conference papers (seven of them first-authored), and one patent he published, which have been published in some of the extremely selective journals with a rigorous peer-review process, making publication in them a rare achievement accomplished by only the very best researchers in the field.
  • On top of all, we briefed his research focusing on medical image processing. His research addresses some of our nation’s most pressing issues, including improving clinical outcomes for cancer patients.
  • To substantiate his case, we included recommendation letters signed by four other well-accredited scholars in the field, endorsing that his research directs the threat of cancer by promoting the safe and effective use of medical imaging techniques in the early identification, diagnosis, and treatment of cancer. The following excerpt has been taken from one of the signed letters:

“[Client’s] research minimizes the risks of radiation exposure associated with medical imaging while ensuring that the images offer comparable quality and equal value for the diagnosis and monitoring of all types of conditions, which is a very important endeavor that should be supported in full going forward.”

We were yet again able to persuade USCIS of our client’s research, providing broad benefits to the medical sector by improving the diagnosis and monitoring of a wide variety of medical issues. He received his EB-1A petition approval in just 7 months following NIW approval just after 4 months of his EB1A approval. We are glad to have this chance to assist our client in achieving I-140 petition approvals. We thank him for choosing North America Immigration Law Group or presenting his both petitions and now we await his I-485 approval.
