Case Summary:

When a researcher from China hired us to help her in documenting an EB-2 NIW (National Interest Waiver) petition, we began a run through her credentials and reviewed her proposed research work on identifying the neural mechanisms involved in neurological diseases, psychiatric disorders, and chronic pain conditions to develop effective treatments and testing treatments for these diseases on animal models. We deduced that her research addresses some of our nation’s most pressing issues in understanding how to develop better treatment methods for a range of diseases and disorders, thereby improving public health in the United States and the rest of the world.

After the successful submission of our client’s NIW case to the USCIS, she retained our services to file another petition under EB-1B (Outstanding Professors and Researchers) visa category to increase her possibilities to get the approvals. Several petitioners get more than one petition filed as it moves them closer to receiving the green card success. Thus, we started preparing for her EB-1B case.

Though both the NIW and EB1B visa categories are precisely different but contain a few similarities. As our objective was to showcase her outstanding academic and professional experience, and unexcelled knowledge relative to her current and future work, we added 209 citations accumulated from the 7 peer-reviewed scientific articles and 1 book chapter she published along with describing her proposed research brief in her petition packet. While publication is almost a regular activity for researchers and professors which is not necessarily indicative of one’s outstanding ability. We observed that our client’s work has consistently been published in the top-ranked journals, demonstrating that her work is recognized as some of the best in the field.

We detailed that her work has also been supported by funding from the National Natural Science Foundation of China (NSFC), the Chinese Ministry of Science and Technology (MOST), and the Chinese Academy of Sciences (CAS). Each of these is a prominent national organization that seeks specifically to advance scientific knowledge in critical areas of study with a range of goals, including the improvement of human health. Hence, this funding activity confirms the national importance of our client’s research and further her success in the field.

Holder of a Ph.D. in neuroscience with vast experience in neurological and psychiatric disorders, our client’s capabilities led to her status as an outstanding researcher. Not only did she achieve her reputation as an outstanding researcher but also confirmed her elevated standing in the field of neuropharmacology as a judge of the work of others. We noted that she had already conducted 19 peer reviews at the time of filing for the petitions.

Lastly, we incorporated five recommendation letters obtained by other national and international experts, attesting to her great influence on the field. The following recommendation has been extracted from one of the letters:

“Overall, I strongly support [client’s] request for permanent residency because I believe she has unique research expertise that will enhance the quality of Parkinson’s disease research in the USA and help improve the care of patients affected by this disorder worldwide.”

We are glad that our client obtained both the petition approvals less than 2 months apart with our diligent efforts in her cases. Our client upgraded her EB-1B case to premium processing, hence her EB-1B case got approved in just 7 days after we filed the petition. We thank our client for choosing us to represent her I-140 applications, and our entire team at the North America Immigration Law Group congratulates her for achieving both EB-2 NIW and EB-1B petition approvals.
