Success Stories: Despite an RFE, a Chinese Researcher Working in the Field of Molecular Biology Received EB-1A Petition Approval
Client’s Testimonial:
"Thank you so much for all the support provided. I have recommended Wegreened to several friends and will continue to recommend Wegreened to my friends.”
On September 30th, 2020, we received another EB-1A (Alien of Extraordinary Ability) approval for a Researcher in the Field of Molecular Biology (Approval Notice).
General Field: Molecular Biology
Position at the Time of Case Filing: Researcher
Country of Origin: China
State of Residence at the Time of Filing: North Carolina
Approval Notice Date: September 30th, 2020
Processing Time: 1 year, 4 months and 8 days
Case Summary:
EB-1A (Alien of Extraordinary Ability) is generally considered a very stringent visa category that requires solid documented evidence to establish the petitioner’s sustained national or international acclaim and extraordinary ability in their chosen field. When North America Immigration Law Group (NAILG) was approached by our client to help her with EB1A filing, we had to determine if her credentials were strong enough to build a good case. Once we were convinced that we could help her obtain petition approval, we commenced the process of assembling an effective EB1A petition which contained the following particulars:
– We meticulously highlighted our client’s notable scholarly contributions: 15 peer-reviewed scientific articles which had already garnered 308 citations at the time of filing. This was a sure indicator of how our client’s research efforts were acknowledged by her peers.
– Our client had conducted 58 peer reviews for established journals in the field of molecular biology. Only top-level experts in their field are invited to perform this important review work, so this frequent review activity further demonstrates oil client’s important standing in the field.
– In order to highlight our client’s superior standing as a researcher, we encouraged her to collect recommendation letters from other top-level molecular biology experts. Of the 5 letters she had collected, the following statement made by a prominent professor is especially noteworthy: “[Client’s] research provides the underlying data necessary to develop an effective chrono chemotherapy regimen. Additionally, her findings regarding the complex nature of the circadian rhythms involved in DNA repair provide a logical explanation for the failure of previous research on the topic. [Client’s] work is thus invaluable to cancer treatment research.”
The recommending experts praised our client’s accomplishments in the field of molecular biology. They also shed light on the fact that her research addresses some of the United States’ most pressing issues in understanding the molecular and genetic factors that contribute to the effectiveness of cancer treatments and the development of preeclampsia. Most importantly, they highlighted that our client’s continued presence in the US will lead to the development of novel diagnostic and therapeutic techniques, as well as innovations in pharmaceutical discovery.
Although our client had a strong case, the USCIS issued an RFE to which we responded promptly and successfully dealt with the hurdles. Overall, the USCIS took a year and 4 months to approve our client’s case. We truly appreciate our client for trusting us with the preparation of her NIW case and wish her the best as she continues to work in the United States.
We congratulate our client on this win and wish her the best as she moves closer to her green card.
