General Field: Pediatrics

Approval Notice Date: February 12th, 2021

Processing Time: 22 months, 3 days

Case Summary:

A lead pediatrician hired us to file an EB-1A (Alien of Extraordinary Ability) petition on her behalf. When she approached North America Immigration Law Group, we carefully assessed her credentials to make sure that she met at least 3 out of 10 criteria to qualify for EB-1A. Holder of an M.B.B.S. degree with affluent experience in the field of pediatrics, her unique and expansive background of expertise enabled her to contribute significantly to the field of pediatrics here in the United States. Therefore, we helped her to organize a customized I-140 petition that shed light on the following points:

  • Research Brief: We detailed our client’s research on providing non-invasive approaches for diagnosing certain diseases and uncovering the mechanisms involved in diseases relevant to pediatrics, including cancer in children, mitochondrial disease, and autism spectrum disorders. Our priority was to convince USCIS of her research which addresses some of our nation’s most pressing issues in understanding the molecules and processes involved in disease onset. Hence, she should be permitted to advance her research unhindered in the U.S.
  • Citation Count: Also, we specified the 120 times her work was cited by independent and foremost researchers from honorable institutions at least in 31 countries, demonstrating the major significance and international influence of her work, as well as the widespread actual implementation of her findings in the field of pediatrics. The frequent references to her verdicts in review articles speak to the leading nature of her work since review articles summarize the most vital results in the field that support continued progress.
  • Publication & Peer-Review Experience: In addition, we highlighted the 3 peer-reviewed scientific articles and one peer-reviewed short communication she published in highly impacting and internationally circulated journals in the field. Her papers have consistently been published in top-ranked journals, signifying that her work is recognized as some of the best in the field. Besides, we noted that our client had also judged the work of her peers 35 times for notably acclaimed journals, proving her active and actual participation as a judge of the work of other experts in the field.
To bolster our client’s petition further, we included recommendation letters signed by 6 other internationally renowned experts in the field. The following excerpt has been extracted from one of the submitted letters:

“All of this denotes her reputation as an internationally acclaimed scientist… It is without a doubt that [client] is one of the most influential and elite researchers in her field. I strongly affirm that she will produce greater work for the United States in the years to come. Therefore, to ensure that the United States remains at the forefront of healthcare and pediatrics research, I strongly urge for her to remain in the United States to continue her work uninterrupted.”

Despite an RFE (request for evidence), our unique petition packet was successful in persuading USCIS of our client’s continued dissemination and the benefits of her work, impacting all parts of the nation by providing a framework for further developments in pediatrics. Thus, she was granted the EB1A approval. We sincerely thank our client for trusting and cooperating with us throughout the process. Also, we would like to congratulate her on this milestone.
