Case Summary:

Exactly 20.5 months after North America Immigration Law Group (NAILG) filed I-140 petitions under EB-1A (Alien of Extraordinary Ability) and EB-2 NIW (National Interest Waiver) on behalf of a lab and research specialist from India, the USCIS approved both petitions. It is not uncommon for petitioners to file multiple I-140s as it increases their chances of obtaining an approval. Despite the long and bumpy road to the finish line, our client is now significantly closer to her end goal of becoming an American permanent resident.

The Challenges Faced Along the Way:

Our client faced many speedbumps along the way to petition approval. Not only did the USCIS issue Request for Evidence (RFE) notices for both petitions, we also had to raise service requests on her behalf when both cases crept outside the normal processing timeline. Because our legal team and support staff were able to respond to both RFEs in an efficient and prompt manner, the USCIS was persuaded to approve our client’s petitions.

What Did the Petitions Contain?

Although both petitions were filed for the same client and were submitted on the same day, they were very different in content and presentation. Even so, several key points remained the same, such as:

  • We noted our client’s research projects on intestinal diseases, metabolomics, hepatitis, and the human gut microbiome. We then demonstrated that her work contributes to the United States’ ability to improve forms of treatment through insight into how probiotics regulate good bacteria production.
  • In order to prove to the USCIS that our client is a leader in her field of microbiology, we listed her professional achievements such as the 115 times her work was cited by researchers around the world, the 6 published articles to her name, and the 7 times she conducted peer reviews.
  • An important element of both petition packets were the six recommendation letters offered by other influential members of the microbiology research community. These letters not only highlighted our client’s research projects and their importance to the nation, they also confirmed that our client should continue her work unhindered in the country. This is what one of our client’s recommenders said about her investigations: “[Client’s] research has focused on improving our understanding of enteric disease such as diabetes, alcoholic steatohepatitis, non-alcoholic fatty liver disease, colon cancer, cirrhosis, and hepatitis B and C.
