Case Summary:

Nearly 15 months after North America Immigration Law Group (NAILG) filed an EB-1A (Alien of Extraordinary Ability) petition on behalf of a gifted interventional cardiologist from India, the USCIS finally sent him notification of case approval. Our client chose to file two I-140 petitions simultaneous (the other was under the EB-2 NIW category) and although he received NIW approval roughly 4 months after filing, he had to wait nearly a year after that for action to be taken on his EB1A.

Among other things, we listed our client’s impressive achievements in the field of cardiology. For one, we noted the 59 citations gathered from his 22 publications, as well as the 14 times he judged the work of his peers. We also incorporated recommendation letters contributed by other medical experts, one of whom stated that our client is “… an essential part of revitalizing hospital policies and triage procedures.” Another expert noted that: “He has consistently demonstrated an exceptional ability for getting to the heart of complex issues relating to interventional cardiology and for developing, as well as implementing, novel studies that push the field forward. He is certainly a rare and necessary asset to the United States of America.”

Perhaps one of the most important aspects of our client’s EB1A petition had to do with his research on interventional cardiology and new protocols for the evaluation and treatment of cardiovascular disease patients. We worked diligently to prove that our client’s work addresses some of the nation’s most pressing issues in developing new heart disease treatment strategies, as this condition remains a leading cause of death in the United States.

Despite the long wait, we are pleased that our client obtained EB1A petition approval. He is now completing the Conrad 30 waiver requirements before filing an I-485 application. We wish him the best as he continues to conduct lifesaving research in the field of cardiology, and we thank him for working with our law firm on his I-140 petitions.
