Case Summary:
Our client’s Ph.D. in Mathematics and many years of experience conducting research have armed him with the theoretical and practical knowledge to continuously progress the field of mathematics. He approached North America Immigration Law Group (NAILG) to help him build and file a strong EB-1A (Alien of Extraordinary Ability) petition on his behalf. After determining that we could, we initiated the legal contract and set to work collecting as much information as we could regarding our client’s research.
What did we include in his EB-1A petition packet?
Amongst other things, we detailed our client’s work on nonlinear analysis of partial differential equations and dynamical system. We also demonstrated to the USCIS that his findings address some of the United States’ most pressing issues in understanding the mathematical bases of physical phenomena. Furthermore, our client’s petition packet contained six recommendation letters contributed by his peers. According to one of them: “[Client] is an essential figure in the mathematics field’s continued evolution and progress. More broadly, his research is necessary for the realization of effective shockwave technology implementation and the enhancement of image reconstruction demanded by medical and radar imaging devices… Therefore, without his input, the effort to advance technology in the realms of aircraft design, satellite image reconstruction, among numerous other applications, would lose a considerable amount of momentum.” Besides that, we also noted our client’s publication record, citation count, and peer review experience. At the time of filing, these figures stood at a dozen publications, 105 citations, and 25 instances of peer review service.
Despite our best efforts, the USCIS issued a Notice of Intent to Deny (NOID). We promptly sprang into action and put together a strong response to combat the NOID. A little over a month after we first received the notice, the USCIS approved our client’s case. We congratulate our client for obtaining an EB-1A petition approval and we wish him the best with the final step in the green card process: filing an I-485 application to adjust his status for permanent residence.
