Success Stories: EB-1A Petition Approved for Postdoctoral Associate from India with 78 Citations in the Field of Epidemiology

Client’s Testimonial:

“I would like to thank the team who worked on my case for the exceptional effort that was put in. As I went through the process I realized that there are nuances in the application which can be known only through experience, which an individual applying for the first time is unlikely to know, even after extensive online research. Your team’s experience and insight of the process is remarkable and has been instrumental in getting me approval.”

Case Summary:

A postdoctoral associate from India approached North America Immigration Law Group (NAILG) for help when she decided that she wanted to get one step closer to American permanent residency. With 78 citations collected from her 11 published scientific articles, it was clear that our client was a significant contributor to the field of epidemiology. Even so, we had to be sure that we could build a strong case for her before initiating an attorney-client relationship. After evaluating her credentials, we recommended that our client file two I-140 petitions: one under EB-1A (Alien of Extraordinary Ability) and another under EB-2 NIW (National Interest Waiver). It is not uncommon to file two petitions as it increases the likelihood of case approval. Our client chose to work on her EB1A first and these are some of the key points contained in the petition:

  • Besides listing her citation and publication count, we also detailed her peer review experience—12 reviews conducted for an array of well-known scientific journals.
  • To further strengthen her case, we added six recommendation letters into her petition packet. These letters affirmed our client’s high standing in the field of epidemiology. One of her recommenders stated, in part, that she “… has proven herself to be one of the most respected researchers in epidemiology today. Also, she is one of a scarce handful of researchers in epidemiology research who is capable of understanding the complexities of facial space infections, proving the benefits of her efforts to the United States as a whole.”
  • We also carefully reviewed our client’s research summary and concluded that her efforts on the epidemiology of aging and the development of programs help the US healthcare system improve the overall health and welfare of the elderly. Furthermore, we proved that our client’s work addresses some of the country’s most crucial issues on how to best care for our rapidly aging population and prevent the high incidence of disability in elderly adult populations.

Because our client chose to file her EB1A petition using Premium Processing (PP), she received notification of case approval 12 days later (it usually takes the USCIS between 4-9 months to process I-140 cases). Upon learning that she had secured EB1A approval, she decided to cancel her NIW case. We congratulate our client for moving one step closer to her green card and we thank her for choosing us to represent her EB1A petition.
