Case Summary:

North America Immigration Law Group (WeGreened.com) helped a gifted postdoctoral research fellow from China obtain an EB-1A (Alien of Extraordinary Ability) petition approval. The USCIS spent 3.5 months adjudicating our client’s case before granting their approval. It would have taken far longer had our client not chosen to upgrade his case to Premium Processing (PP). PP, as the name suggests, allows for accelerated processing (15 days instead of 4-9 months). In this case, our client received an approval notice from the USCIS merely 8 days after his case was upgraded to PP.

We spent several months preparing a strong EB-1A petition that incorporated a myriad of information on our client’s various research accomplishments. This included, but was not limited to, data on his publication record, citation count, and peer review experience. At the time of filing, our client’s publication record stood at 2 book chapters, 20 peer-reviewed scientific articles, and 16 presentations at national and international conferences. As for his citation and peer review count, they stood at 139 citations and 56 reviews conducted for nearly 30 scientific journals when we filed his EB-1A petition.

Thanks to the comprehensive research summary that our client provided us, we were able to conclude that his development of computational mechanics-based models and simulations of different materials and structures at various scales help the United States in areas related to the mechanical behaviors of advanced engineered structures and materials. To support our argument, our client enlisted the help of other experts in his field of civil engineering by requesting for recommendation letters. Six experts agreed to lend their support, all of whom were either familiar with our client’s publications and/or had worked with him. Here is what one of them had to say about his work: “Considering the financial implications of [Client’s] research to American industries and the lagging job market, it is absolutely critical that [Client] be allowed to pursue his research in the developing simulation -based engineering industry.”” Another expert echoed: “[Client] is able to bring cross-disciplinary knowledge that other researchers in the field simply do not possess. Given [Client’s] exceeding role in the field today, there is no question that his research will continue to benefit and further the discipline.”

Final Step in the Green Card Process:

We recently provided our client with our comprehensive I-485 D.I.Y. Packet. This packet contains all the information needed to help him with the I-485 application (the last step in the green card process). Once the USCIS approves our client’s application, he will become an official American permanent resident. We wish him well with this and thank him for choosing to work with our law firm.
