Success Stories: EB-1A Petition Approved for Research Assistant from India in the Field of Food and Nutrition Science

Client’s Testimonial:

“I am really thankful to North America Immigration Law Group and every attorney who worked with me on my case. It’s been almost two years, I have been in touch with this team and like many of us, I did not have complete faith in them at the beginning of the case. A friend of mine recommended this firm to me when her case was successful. During all this time I had neither a single complaint about them nor a single doubt to their professional skills and capabilities. They always came up with the best response and course of action possible while my case was pending. Long processing times with the USCIS can be frustrating but a qualified team can make all the difference- whether to win or lose the case. This entire team is really supportive and I can say, if you are here with Chen’s you are at the right place and just believe in them. This is the only recommendation I have for this team and advice for many of you coming behind me. They know how to win the case so just work with them. I cannot imagine what my case would be if I hadn’t been with them. Props to this great team!!”

Case Summary:

Some time ago, a research assistant working in the field of food and nutritional science hired North America Immigration Law Group to file an EB-1A (Alien of Extraordinary Ability) petition on her behalf. Our client, who obtained her B.S. and M.S. from an institution in her birth country of India, received news of her petition approval just over a year after we filed her case.

The reason for the lengthy adjudication timeframe had to do with the Request for Evidence (RFE) that was issued by the USCIS after we raised a service request and its follow up. Our legal team handled every aspect of communication with the USCIS, thereby giving our client the opportunity to focus on her research.

Our client studies dietary phytochemicals and their ability to prevent or inhibit the development of various cancers, and her work helps other scientists determine how natural substances can contribute to the human body’s ability to fight devastating diseases either in place of or in addition to major medical interventions.

One of our main duties was to prove to the USCIS that our client’s research is essential to the health of Americans and advancement of the United States medical sector. We supported our claim by helping our client reach out to expert nutrition scientists to request recommendation letters. One of these experts stated that “With the risks for skin cancer continually on the rise, [Client] has been contributing critical information about natural agents that are capable of preventing the irreparable damage that can lead to skin cancer development […] essential for the development of novel, affordable, and effective cancer therapeutic drugs.” In preparing our EB-1A petition packet, we also included information on our client’s 446 independent citations, 21 published papers, and 17 instances of peer review service.

We congratulate our client on her I-140 approval and wish her the best in her continued research.
