Case Summary:

Just 2 weeks after North America Immigration Law Group (WeGreened.com) filed an EB-1A (Alien of Extraordinary Ability) petition on behalf of a respected oncologist and hematologist, the USCIS approved her case. The reason our client did not have to wait between 4-9 months for action to be taken on her case is because she opted for Premium Processing—the USCIS guarantees that action will be taken on PP cases within 15 days.

Proving her extraordinary ability in the field of oncology:

In order to help our client secure EB1A approval, we had to demonstrate that (1) she met at least 3 out of the 10 evidentiary criteria set by the USCIS, (2) that she is a top researcher in her field, and (3) that her work benefits the United States. Regarding the criteria, we claimed original contributions (179 citations), authorship (10 peer-reviewed scientific articles and 2 book chapters), and judge of the work of others (30 peer reviews). The aforementioned numbers were gathered at the time of filing.

We then explained that as a top researcher, she is one of only a few experts who can carry out research on the implementation of translational research into clinical trials in order to enhance the quality of life and to increase life expectancies for cancer patients. Our goal was to persuade the USCIS that her research addresses some of the United States’ most pressing issues in understanding how to more effectively treat cancers for which few treatment options are available.

To prove that our client’s work is of great importance to the nation, we urged her to reach out to several of her peers and ask for recommendation letters. She convinced 6 of her peers to lend their support, all of whom are influential medical practitioners. According to one of them: “… [Client] has served the public health and economic welfare of the United States on a national level, so it is essential that [Client] continue her research in this significant area of endeavor.”

We are pleased that our hard work led to case approval, and we congratulate our client for obtaining EB1A petition approval. We thank her for retaining our I-485 services, and we join her as she waits for the USCIS to take action on her I-485 application.
