Case Summary:

A postdoctoral research fellow from India engaged the expert services of North America Immigration Law Group (WeGreened.com) to help him obtain green card success (two steps are involved: the I-140 petition and the I-485 application). Our client was aware of our firm’s excellent approval rates and knew that we would do our best to help him accomplish his goal of attaining American permanent residency. After evaluating his credentials, we verified that he qualified to file his I-140 petition under EB-1A (Alien of Extraordinary Ability). As this visa category has a very high standard of law, we had to prove that our client’s credentials met at least three out of the 10 requirements set in place by the USCIS. We concluded that our client’s EB1A petition should focus on the following requirements:

  1. High Citation Count: We used Google Scholar and similar references to determine that our client’s work had amassed 577 citations at the time of filing.
  2. Impressive Publication Record: Our client’s many years of research on the design of new platforms for medical diagnoses and therapies have led to a dozen scientific articles, three book chapters, and three granted patents.
  3. Extensive Peer Review Experience: When we filed this EB-1A petition, we noted that our client had already conducted 26 peer reviews for a variety of high impact scientific journals.
Using the aforementioned data and other supporting evidence, we proved to the USCIS that our client’s work in the field of biomedical engineering is valuable to the United States, especially its pharmaceutical and healthcare sectors. Furthermore, we used our client’s academic accomplishments to establish that he is equipped with the theoretical knowledge to carry out practical work in the field. We also demonstrated that his research findings contribute to the progress of other researchers’ work, and we incorporated recommendation letters contributed by five of these researchers to prove our claim. Here is what three of them had to say:

“It is clear that [Client’s] accomplishments in biomedical science and engineering are of the highest standard, and that he is an unusually talented researcher. As further proof of his high standing, I would like to mention that I have cited his work in one of my studies, which provided invaluable insight that informed my research.” –Distinguished professor and bioengineering director

“It is my professional opinion that [Client] has, and will continue to, complete great work in the future, and public health would benefit significantly were he allowed to continue his research in the United States.” – Prominent life sciences professor

“Judging on his already substantial achievements, it is obvious that [Client] will continue to produce the highest quality research and impact not only his field, but the nation as well. [Client’s] publications have received much attention from his peers in the form of citations […] which makes it clear that his peers have benefited from and implemented his findings in their studies quite often.” –Well-known postdoctoral associate

Not long after receiving the approval notice from the USCIS, we helped our client put together his I-485 paperwork and submitted it to Texas Service Center on his behalf. We join him as he awaits a favorable decision. In the meantime, we would like to thank our client for selecting our law firm and we wish him well as he continues to advance his field of biomedical engineering.
